I just got a DUI and I need some advice badly...

Don' t know if it is the same in Illinios, but in Michigan, refusing a pbt is a bad thing, especially if you fail. Refusing is truely ignorant, all they will do is get blood out of you. Happened to me, refused trying to be a hardass, took me right to the hospital, drew blood and throw my ass in jail. I got stuck with the hospital bill, extra fines, and 6 points on my license, all for refusing the inevitable...

First off by refusing to take the breatlyzer you did the right thing mainly because you are underage. The results of the the test is your evidence against you when you go to court. However, by refusing to take the breathalyzer, you will automatically lose your driver's license for 1 year, and when your case goes to court the judge is allowed to view your refusal as evidence of your guilt.

Now, hopefully since you refused the breathalyzer, there were no other alcohol tests (urine or blood tests) performed and you did not have to do any sobriety tests. I say this because under law: "While proof beyond a reasonable doubt is not required, mere suspicion is insufficient to demonstrate probable cause for arrest. A guilty verdict can not be assigned to an arrest for DUI based solely on the odor of alcohol."

well, something similar happened to me when I was a teen. i wasn't driving, a friend was. we were all underage. got pulled over, and we had beer in the car....so, the cops gave us all breathalyzers. none of us were drunk at all, we all had a very low amount of alcohol in us, not even close to being above the legal limit. so, the cops said we basically couldn't drive the car, and took us to the station, took our beer. that was pretty much it, no underage drinking charges or anything. they even gave us a ride home...lol.

i would say we got off pretty lucky, but we were also very cooperative, if we hadn't been, i think we would have gotten off worse.
 
Yeah, Citruscide a.k.a. 'C-Ditty' is a liscensed attorney in Illinois, so he may be able to give you a few pointers. I think you said that is where you are right?

But either way, you fucked up. I am sure that you know that though. You may not have been inebrated or impairedbut being under 21, blowing even a .01 would be a DUI, so I don't necessarily blame you for not taking the test.

I think some MAJOR constitutional rights were violated if they're strapping you down, punching you, and sticking a needle in your arm like that. I'd sue the fuckers.

In almost all 50 states, you can have blood 'forced" out of you if you caused an accident.

In some states they can do it for a suspected DUI.

Damn I was thinking the same thing as supernav. So "suspected DU" is OK but suspected Murder or rape, You need consent for a sample? damn.
