I just got a DUI and I need some advice badly...

thanks for the update chewy. it is kind of cool when an old thread is brought back to life. i remember this one.

i am an insurance man and have seen what hell it is going thru a DUI, the expense, the courts, the lawyers, the embarrassment (especially for people not so young anymore). it is enough to discourage me from ever taking the chance.

last night in san diego a drunk driver hit 17 parked cars, a fire hydrant, and a building. noone was injured boy but is that guy in a heap of trouble. it was all over the news today.

I refused to take a breathalyzer once, and the cops took me to the hospital to get a blood test

I did'nt agree to the blood test either but they said they would forcibly hold me down if I offered resistance so I let them take my blood but did'nt sign anything that said I was giving them permission and refused to talk until I had a lawyer

my blood alcohal came up .15 so I hired a lawyer and got the test thrown out because they did'nt have the machine that test the blood caliberated in over a wk and state law requires it to be caliberated daily

This probaly happens alot but just never gets challenged
 
I didn't go through all the posts and maybe this was touched on. In every state that I know of, if you refuse to submit a breath or blood sample you lose your license for one year. It is called Implied Consent and you have to submit to a test when requested. A laywer would be good to talk to just to see what your options are but he won't be able to get you out of the suspension. Look at it this way though, you lose your license for a year but have no DUI on your record. They cannot charge you without proof. Good luck bud. FYI always take a breathalyzer, blood tests nearly always come up a higher BAC.

Thanks, but FYI never take the portable breathalyzer because it is grossly inaccurate. The police admit this, which is why the PBT blood alcohol level isn't even usable in court. They have to take you back to the station to use the non-portable one for it to be used as evidence.
 
it wouldve been better if you woudve blown. i got one and i blew but i got off the DUI and got a careless driving charge. it costed like 5000 though but it was worth it.
 
Here in TN it's 6 months revoked if you refuse a breathalyser.

Do not blow if you know you won't pass! This is automatic proof and then you are guilty.

Always tell them you have had NOTHING to drink. They have to write it down as such and weakens their case which makes them mad.

I'd much rather loose my license for 6 months than a year, fines, fees, jail, classes, probation, etc.

I will always refuse to blow in the future.
