Do judges consider a convicts age when sentencing?

I mean giving a 65 y.o. a 20 year sentence is equivilent to life ... right?

Also, wtf is up with consecutive life sentences? Seems like one life sentence w/o the chance of parole is sufficient.

Well, sometimes there are sentencing guidelines for set time frames that a judge must stay within. However, say that the mandatory sentence is 5-10, a judge or a jury can consider any mitigating factors in determining the proper sentence. Youth and inexperience are commonly argued mitigating factors.

A life sentence is only 30 years. if you REALLY want someone young-ish in jail for life he needs multiple life sentences.

I hate the "jails are overcrowded" comments. Fuck that. If you've committed a crime, then go to jail. This cell can fit 12 people in it, open the door, shove them in, and lock it. Lunch time... throw 12 meals in there. Dinner time... throw 12 meals in there. 20 years later, let them out.

Then we'll see how people think twice about committing crimes. It's a joke now. In and out of jail like a freaking time share having motherfucker. The guy who robbed my house was in and out of jail so many freaking times, they have a wing for him there. He was out on parole 5 months and robbed me. Who knows when he started robbing other houses before mine. He was also arrested for drugs when he got arrested for my house. Now he's back in... Yeah, see you next year. Fucking insane.

Make sure you treat them nicely. Fuck that. Carreer criminals shouldn't get good treatment.

Bottom line, throw them all in one cell. No such thing as overcrowding.
 
If a judge really wants to fuck you, he has your sentences run consecutively as opposed to concurrently. What "Life" means changes from state to state. In my home state, twenty five years is considered a life sentence. However, the judge can sentence you to "life" without the possibility of parole. Or they just sentence you on multiple crimes and you get a total of like 169 years.
 
Most of the time, the judge will let the sentences run concurrently. Like nate said, if a judge makes them run consecutively, the judge must feel that she or he is really a danger to societly. When they run consecutively, it pretty much messes up the chances of parole because even if you get paroled on one sentence, yuo have to immediately begin serving the next.

I've never heard of life sentences being only 25 years. Honestly, I would have to look that up. I have never defended anyone who was facing a life sentence. I mainly did drug charges. So, I never had to look it up.

Don't some drug charges have life sentences (e.g. high volume trafficing in school zones, etc...)?

Nothing that I ever defended did. I didn't do the the federal cases involving crossing state lines or stuff. Where I was from, pretty much the only felony charges that were popular was the manufacturing of methamphetimines. I had to learn the different methods of making meth in order to defend the cases. It was interesting stuff. That was really the big popular drug when I was doing crim def. =-)

You know, you've got a point there, my long time member/ short time poster.

But I still get angry at the fact I worked very hard to buy my wife's $7000 engagment ring, jewelry, camera, and other stuff that was stolen from my house. The guy had just gotten out of jail after a long history of doing this. That equals a carreer criminal. He's done it time and time again. If you had a gun to your head, would you say he'd do it again when he got out or he wouldn't? I'd say he would.

He'll fatten up in jail, get new plans on how this time he won't get caught, and he'll be at it again. Here he is... Smile! My daughter was in the hospital, so I couldn't go to his sentancing the last time he went to jail. I was told the judge would have given him a higher sentance if I said something in front of the court. I just couldn't make it. I wanted to see him before he left to fatten himself up for another round.

He's 5ft 7 and 145. lol I would have broken him intwo if i caught him in my house. Yep, then it would have been me going to jail. Maybe it's a good thing I didn't get home in time.


"Maybe he had a gun"... Ehhh, depending on circumstances, guns aren't as dangerous as you would think. If i were close enough to him, I would trade the possiblilty of a bullet to get to him.

No comment on the last part.

My point is, there are lots of people in jail for the right reasons i.e. rape, murder, child molestation, violent crimes, robbery (In your case, people like that guy need to be locked up. No doubt.), etc. But then again, there are lots of people in jail for the wrong reasons - drugs (and yes that includes steroid possession/use) and marijuana possession/use/distribution, defending themselves, etc. So to say "If you've committed a crime, then go to jail." is an extreme statement. I just don't think the punishments always fit the crime. For example, the "war on drugs".....what a joke! Unfortunately, the laws are not going to change anytime soon.

If you were home when he invaded, you wouldn't get into much trouble, if any, unless you actually killed the guy when he wasn't a threat.

Even then, it would have been hard to prove it, and even harder to get a jury not to sympathize.

You make a lot of sense, and I agree with you, but I have so much anger from all of this that it just frustrates me. I'm sorry that my words took you out of a hibernation to want to post about it. 2001 join date. lol

My wife didn't even want to sleep on our bed after he totoally ransacked the entire house including the bedroom and every square inch of the place. He must have been in the house a good 30 minutes.

Trust me, I can see why you'd be pissed and frustrated with that feeling of being violated. My x-girlfriend got raped last year, so I know what it's like to be extremely angry at a certain type of person. In my X's situation, I felt like that shit might as well have happened to me. It really fucked me up in the head to know that someone intentionally hurt someone I love. I couldn't sleep for a couple days, couldn't stop thinking about it, etc. I completely understand having that built up anger and wanting to kill someone over it. Some motherfuckers just need to die and make the world a better place. I hope they put the guy that violated your household away for a long time. Hopefully after time passes, it will mitigate the feelings you and your wife experiencing. Good luck to you and your wife.

Thanks, you too. That sucks man. Honestly, I know it could always be worse. We tell ourselves that it could have been worse had I caught him in the house because you never know... I have a family to think about now.
