How much trouble can I get into for doing this?

A little background,

I have open access to personnel files, they aren't in my office but I sometimes need to access them for review and such.

Well, I don't need or want to go prying in anyones business, but with the latest shit that came about with this ball less prick I did take a look at my own personnel file and well, wasn't pleased at some of his write ups about me.

Half of which my boss didn't even give the time of day but still put them in this back up file here. This is not the 'main' file, thats over at the HR dept.. but still

so now thinking back and trying to expand my horizons I want to copy all of that shit in my file for my personnel file. I would suspect that it being my file I should have every right to do so.. am I correct?

Half the shit in there is too damn funny to even think its serious..

esp keeping in mind..... he's not my superior and we are at the same level in the company, YET he thinks he can write me up for stupid shit. I'm actually (believe it or not) very dedicated to my job, work thru lunch and over time even though I am pure salary, so some days due to kid projects, I may be 10-15 mins late.. but we are talking very seldom.

One particular week his panties were all up in a bunch, we prolly had butted heads on something, dunno.. and I came in 2 mins late and he decided that he would write me up.. LOL... His statement on the write up form was so damn hilarious too.

Needless to say, I'm just seeing these papers now. That kinda pisses me off, that I was never told he'd been doing this shit for months, EVEN though it was just being overlooked, I still would like to know if someones standing behind me ready to stab a dagger in my back or not.

So anyway, do I have the right to have a copy of everything in my personnel file?

5 years of shit from someone, which inturn runs me off of the best damn job I have ever had and Now I have to start over.

I did let it go the minute I didn't take someone dear to me up on the offer of waiting for him late at night and beating the piss out of him and leaving him there... Thats when I let it go.

Sadly enough I'm the only damn person (employee including his welders) to stand up for myself and agains the bullshit this man does and says. They all want him gone because of the shit he does but not a one of them does a thing because they are afraid of losing their job.

Well, I've listened to it enough. Its either stick around her and let it 'go' be miserable or keep climbing the ladder at making sure this is taken care of in a timely and responsible manner. If not for me, for the next person he thinks he can bulley around.

I promise you, Most of you would have beat the piss out of this man for some of the shit he thinks he can say.

2 separate questions:

1) whether you had a right to copies of your file would be a function of state law, and/or emplyment agreement.

2) but I could definitely see them saying you abused your access to the files by checking/copying your own (iow, without going tru proper channels). if they needed some reason or justification for firing you, that could provide it.

They are considered company property and you can get in serious trouble.. at least in canada.

If in your contract you r to be told whenever you are written up, it different. Labour laws and issues concerning privacy are very tricky

but to copy them without permission could get you in hot water.

Acknowledge to your superiors you came across them and that you have some objections.

I wouldnt say you read them already, just that you were concerned about whats in them because of your ongoing fued with the soon to be ball-less one, and would like to see a copy. if they balk, then you can ask about whether you have a right to them etc etc

Well, if there were some 'book' anywhere around this place that set in stone the rules I would be worried.

the only thing I signed when i started here was a confidentiality agreement for the plans and prints and designs that I have access to or draw up for the company.

until this harassment crap with me there wasn't even a policy on sexual harassment in the work place... as a matter of fact, I'm yet to see the one they were supposed to put in place.

About 1 year ago we finally got a dress code policy which is very dull. And 6 months ago we got a alcohol and drug policy.

The personel File is not you property it is the companies, and you could get in trouble for copying it

if he truly is an inferior to you and he has no influence it wont do you much good to fight something that has little bearing on you.

I guarentee you will not get the same files you are reading now- where you have access at... The ones at HR are not the same and never are at any corporate biz...my suggestion- copy all files you have access to...be quiet about it. These files or reports are "cumulative", some may be stupid or "piddly" but as one they are and can be used against you if such a time ever occurs....there are no rules in love and WAR...

edit: as the same token, you can use them in your defense if the situation ever arises...

Mav, thats what my intentions are. I know of three files in there because he brought them to my office and went off on me and said I had to sign them. I read them and I've told HR about those, but she has no copy of any of the write ups but knows they exist.

My concern is given the actual business im in and LA as a whole and its whole corrupt way of handling things, I am afraid of just letting it slide and being told that I should have addressed it sooner and by not doing so I was in some way accepting what was being said.

In the case of this review type material, you should be allowed to view all of it, and I would suggest that you do so in an appointment with your direct superior, or the head of HR.

And files on company property.. regardless of their nauture can not be caleld personal..

They are write ups based on behaviour in the work place.

You have to cover your ass at all costs, but make sure your not putting nails in your own coffin in the process.

If you have access to any type of lawyer, try to speak to them...in labour issues you just never know

That's a pretty fucked up company -- that keeps information on it's employees that their own employees don't have access to. How shallow.

Twoof them I did sign.. The ass wipe told me My Superior gave him control over me. Which he was lying thru his teeth. After the second one for NO reason I went to my Manager and asked what the hell was going on, where he assured me That the guy had no authority over me and he would not be writing me up again.

We work in two different departments, but hes an ego asshole. We are actually on the same step of the ladder, below my Engineer but he likes to think he's almighty important.

After I talked to my engineer and he came to me trying to stir shit again with some silly shit about me being 2 mins late LOL, I told him that if he had problems with me he should take it to The Engineer, that I wasn't signing a danged thing and I'd appreciate it if he kindly exited my office.

I spoke to the owner of the company about the write ups also and they informed me that they told him directly to mind his own business. My work enviroment and his and his welders are totally different. I can come and go as long as its cleared as I need (and I'm not abusing it) It eats him up. He expects me to follow all of his outragous rules he sets for his welders, and i flat out refuse to.

Let me add that though this ass has been making my working enviroment a pain, I've had some very good years here. Excellent pay, benefits, retirement.. etc and when i do have family issues (esp now being a single parent) i don't get any beef from them.

There are managment issues, and people like this guy who think they are more important and have more clam in the company.

The particular divisioin I work in was started a lil over 6 years ago, he was one of the First employees.. I came about 8 months later... Both of us are valuable to keeping the production going. It puts my manager in a tight spot and I know it does... I'm not trying to do that but I'm also not the kind of woman to take things lying down.

We both can be easily replaced, no doubt but it would take years to train someone everything that either of us has to do on a day in day out basis. We tend to and fabricate a wide variety of equipment.

I really love this company, its owners and most of my coworkers.. One bad seed has made me not want to come to work some days.

Just a basic note (like you can get from office depot) with his complaint.

I'd never in my entire working career been written up.. LOL at first I didn't even know what it was.

The thing that bothers me the most is the fact that upper managment and HR told me he had no right and that it wouldn't go into my personnel file, it didn't make it to our main office, yet it is in my file at our office. IMO it should be shredded and not left there if it isn't on my record.

omg and you would kill over laughing if you actually knew his job title.

he's the freaking Shop Foreman, over the welders (no suit and tie) I work in the office, complete different enviroment, hours, job title, whole other world.

I swear the man got so anal at keeping track of everything I was doing I bet he knew how many times a day I pissed and washed my hands.

We both work directly under the same manager and he has his crew of guys. he for some reason seems to think I should be one of his guys

he's an overgrown outdated hippy.. not much formal education at all. He's worse than any woman I have EVER worked with when it comes to gossip and being crabby.
