Highway project is taking my property

I have an acre of land with a 14000 sq ft paved lot a 2000sq ft 3 bay garage with office carlot. My father started this business after he retired from B.F. Goodrich tire Co in 1987 and i have been invovled since returning from California in 92, i worked construction but had money invested hoping one day to use it toward retirement. We were buy here pay here when no one else was doing it. I was injured in a construction accident 7 yrs ago and got into the lot full time soon after as my father was ready to retire for good.

Now the department of transportaion is going to widen the road and it will consume part of the building therefore they are taking the whole thing. Granted the garage and office were basically a pole barn (inexpensive)but the office part is nice and the shop has been insulated and concrete slab floor. Oh also have another .5 acre with a rental house on it very small 1200 sq ft. The only other property for sale on the highway that is a mile from us has an asking price of 100,000 an acre there is another property 1.5 miles further from town with an asking price of 60,000 for a 3/4 acre lot. they are offering about 50,000 for the lot and 35,000 for the house. When i asked why i got such a low offer they say the appraisal is taken from property that has recently sold and what it brought. Not what is for sale and they dont do replacement only aquisition! Hell i feel they should give me what it would take to replace it if i built across the road from where i am but they say NOT!!!!

My frustration is that i did not ask to move i am forced that being said ther are no places available for me too move into that are anywhere near the size i need, i have about 30 vehicles in inventory and that varies from 10 to 30 at any given time, has anyone ever dealt with anything like this. I threatened to get the media involved saying at a time when tax dollars are bailing out losers the government is being tight with us a mom and pop 2nd generation biz that oour own tax dollars are buying. Trust me if i had put this up for sale i would not have sold it for less than 200,000 therfore they are offering about 1/4 what it's worth we have an apraisal from 12 yrs ago that makes it worth double there offer. Sorry for the long ass post but i needed to vent any help would be appreciated and if you dont have any helpfull info then OK make me laugh!!!!!!!!!!!!!!!!!!!!!!!!!K to anyone who can do either
 
Trust me i've read the whole thing about the imminent domain, the good thing is theres an attorney who they are doing the same thing to in this project and he is getting the same treattment ther are about 15 of us who are unhappy and have agreed not to sign until everyone is. Power in numbers
 
I thought there was a negotation process. You don't have to accept their first offer ... right?

The libs on the Supreme Court fucked this up a few years back.

I feel for ya.

I am not an expert on the issue but if they take it make sure you get an attorney who will get you the largest payout possible.
 
true and if i dont counter i can easily win in court, ther is a company that contracts from the state they will negotiate until they reach an agreement or they cant then thay turn it over to the state and it goes to a 3 person commission it is a real screw. i was contacted by one of the higher ups and she said after 22 yrs everyone she has dealt with said it was the best thing that ever happened to them i said bullshyt.
 
its just seems that when a lot of peeps are getting bailed out on wall street through tax dollars the average guy is gettin screwed. Theres a lot of home owners and a veterinarian and a new car store also being aqquired. All this to make the road wider so people can get to the casino quicker!
