Got Rear-Ended!! Questions...

The car kind, not the gay kind -- you pervs!

The car:

91 Honda Accord Wagon ES (don't laugh -- i like my baby).

The situation:

Driving on sunset blvd in Hollywood sat night like 4am. Bumper to bumper traffic. Stopped at stoplight. 2 passengers in my car. BOOM! Got rear-ended by a black Cadillac Escalade SUV. The occupants were 2 black males and a 1 white wigger male -- coming back from some huge rap concert down the street.

The black male driver, obviously drunk comes out. Starts doing the schmooze deal. "I'll take care of ya bro. We got NBA player Rik Fox in the back seat passed out (it wasn't). We got money yo. Don't call the cops. We work it out. Here I got a $10,000 necklace i can give you for now. We got money, we'll pay you tomorrow.".

Blah blah blah. 45 minutes later, 50 lies, fake phone #'s, none of them have DL's. ATM cards that "apparently" don't work later -- i give up and call the cops.

Cops arrive. Black male driver now *changes* his story and now he's not the driver anymore. He also claims our damage was there "before". He then makes his 22 y/o white male passenger friend to take the fall. Funny thing is, he didn't have a DL either! The car didn't belong to any of the 3 occupants. LAPD cops were giving them all a hard time, while we just sat back and watched.

The damage:

Rear bumper was hit hard on the back right. Light cracked. Fender bent and bit of the hatch was dented too. Nothing major. Around $1700 damage.

Insurance:

I got insurance. They got Infinity insurance they presented from the vehicle. Owner lives in San Diego.

soooooo............

The fault is pretty much open and shut case. What I'm wondering is -- what's the BEST way to go after these guys for damages? We (us 3) obtained a laywer to file for bodily injuries (we all got whiplash). Hopefully his insurance will be valid, and we can claim against that.

Any suggestions. Anyone been through this kinda deal? Already went to doctor asap the next day.

Nav you traded in the 3000GT and got a station wagon accord? was that for extra room for guitars or what's the deal?

the only thing i can think of that pains me more is wodin's porsche for minivan trade. then he tried to blame it on the fact that he has a family now. i'm like, put the kids in the trunk.
 
not that i would advise a client to claim fictitious injury, but since you're just some dude on ef, here goes. soft tissue injury is the moneymaker. sprains, strains. and insurance companies prefer to go into the new year with as few open cases as possible. i have had much better results getting favorable settlments at the end of the year, so don't rush into a settlement. if your lawyer is any good, he'll tell you all of this.
 
if you think you are actually going to get $ from any of them then you must of got one hell of a concussion from that accident

So if they dont have insurance, how can you claim bodily injuries?

Would you insurance pay for it?
 
With a $45,000 SUV. I'm sure they got insurance. We'll find out within a week if their insurance policy was legit, or was a fake ins. card.

in cali you can sue for medical expenses, visits, travel time, time off, loss of enjoyment, loss of income and the biggie --> pain and suffering. Basically a whole bunch of stuff. The most sue-happy state in the US.

But if he is not an insured motorist......how are going to get money?

dunno.

meeting with the lawyer later on 2night. With all the illegals in cali driving w/o DL's and insurance -- i think cali has uninsured motorist coverage to protect the insured public.

Plus the owner can be charged for not having ins. or sumthin'.
 
i was rear ended by a dude who wasn't driving his own car and had no insurance.

my insurance company covered the damages to my car (the frame buckled). i lost the deductible ($500), which i wanted him to pay, but he filed for bankruptcy and that was that. money lost, case closed.

good luck with your case. i hope they really do have insurance!
 
Was the accident your fault? That blows that they made u pay $500 for someone else's mistake. The amount of people in cali w/o insurance is staggering compared to other states. It's sad really.
 
I`m not sure if in New Jersey the option of "uninsured drivers" we have is for times like this? I`m guessing you don`t have that there in Cali.

lawyers are shady....
 
Here in VA, you have uninsured motorist coverage that part of your insurance....only thing sucks i believe that you have to pay the deductible.

i'm surprised the LAPD didn't get them for DUI and other stuff....hope you make out like a bandit.
