got in a car accident yesterday

sorry bros, i know this doesnt go there, but i thougtht id ask for some advice.

my sister and i were driving on the highway the other day. she was driving and all of the sudden the car in front of us slammed the breaks. my sister hit the breaks but wasnt able to stop the car in time or swerve out of the way... so we hit th other car. it wasnt abig accident, nothing serious, but i got out of the car and went to ask the other driver if he was fine. which he claimed he was. thats when i noticed that there was a piece of furniture on the floor infront of his car. i asked, and he otld me that the pick up car in front of him didnt tie the furniture down, so it fell from theyre truck, and thats why he had slammed the breaks.

cops came like an hour later, and immediately told us we were getting the ticket. since we hit the guy in from behind. Then, some guy in a truck drove by us, and yelled at me to run to his car. i dunno why, but i did. mid you,m that we were still in the middle of the highway, and cars were swerving by. anywyas, he gives me a little piece of paper with the pickups trucks tag number. tha guy had seen the whoel thing, followed the pick up, then got off the highway, retook it heading north, got off it again,m and then retook it going south to meet us... what a nice guy.
i told the cop, and he told us that it didnt matter, that we would stil lget a ticket. another hour passed, and apperantly the cop came to talk to us. explained that he had ran the tag we gave him, and it was registered to a furniture store... he called the owner of the truck, and made them come to the scene. when the truck came, the car we had hit recoginized the pick up.

long story short, the officer gave the ticket to the pick up that dropped tha piece of fruniture, and said they were solely responsible for all damages caused to my car and the guys car we hit. the pick up was found at fault, and hence was the only one to get the ticket.

i was feeling fine all day yesterday, but my back is now killing me. it seriously hurts even when im laying down. i suffer from bad back pain, and this fucking asccident has made it much worse. what should i do? can i sue? should i sue?

If you rear-end a car for whatever reason, you'll be hard pressed to get anywhere in court.

You got out of the ticket... that's more than most people get for such a circumstance.

Yer sorry dude, you dont have a leg to stand on. They will say that your sis was in the wrong because she didnt leave a big enough space between you and the car in front to stop in time.
 
Unless you want to sue your sisters insurance company theres not a whole lot you can do.
 
the cop told us that the new florida law, is that if anything falls of a truck/car and that causes an accident or any damagaes, then that truck/car is 100% at fault for any damages or accidents caused.
he told us it was a new law, that it use to be that that person only got fined. but now they are solely responsible and they HAVE TO appear in court.

like u guys say, when the cop first got there, he said we were at failt no matter what, since we should have been far enough to stop the car on time, be it our fault or not the accident was caused. after making us wait like an hour he told us about the new law. and that under florida law my sister wasnt responsible for the accident, but the once that caused it were. hence, no ticket to us, just the pickup.
 
you always hurt worse the day after a car accident. take some motrin and or naprosyn. take 800 mg three times a day or 600 4 times a day. take the naprosyn twice a day. these are NSAIDS and will help with any pain.
 
It can't hurt to see a doctor, and the sooner after the accident the better. If your back is fucked it will be easier in court the sooner you go to the doctor after your accident. If you wait, it will look more like you are looking for money, or something else caused the pain. If it gets better no sweat off your back, if it gets worse and you do decide to take it up with the insurance company or the furniture store owner it makes it easier on you.

Definitely good to hear that you weren't seriously hurt.

Becaue the ticket was given to the furniture truck, that means the law is on your side. So criminally the decision has already been made that you were not at fault and 100% fault was given to the driver of the furniture truck.

So if you sue it becomes a cival suit and effectively you have already been awarded a 'no fault' in a criminal suit. So long story short, you would have a very good chance of winning if you sued. However, if you already had back problems you would have to prove that the accident is the cause and they would ask for history.
