got in a car accident yesterday

most definitely see a doctor to document your injury, x-rays MRI's follow-ups etc......
if it comes to be something serious you will have some info.
I was in a similiar accident, I was the passenger and hurt my shoulder pretty bad - went to the ER and had it put back in socket and surgery was needed.
The insurance companies in KS worked well with me, basically we followed up with the driver's insurance (my dad's) and they investigated and reviewed my case and then the person at fault's insurance would pay my dad's insurance company back
 
spoke with a lawyer today, he said i defently have a case. i have to meet with him sometime next week. i gotta tell u guys, my upper right back is killing me right now. i slept on the floor yesterday, since somebody told me it would help. i couldnt, terrible back paina dn i woke up with lower back pain aswell. right now, it feels like i have something poking my in the back.

see a doctor and some other professional health care docs, even a sports surgeon. they will be able to diagnos what is causing the pain in your back, not your lawyer. Also, talk with your sisters insurance company about the pain and tell them you are going to see a doc (dont tell them about the lawyer). insurance companies rather not deal with lawyers, in my experiences anyways. the insurance companies I have dealt with have treated me very fairly with my injury. I didnt hire a lawyer becuase I found out what the usual payment for someone with my injury would get, and hiring a lawyer to take a big chunk out of that would not be worth it. If he did get you more money, alot of it would be paid for the lawyer's services

I'm always weary whenever a cop mentions a "new law". Police officers make up bullshit all the time - they even write tickets for crimes that don't exist.

For example, in Canada, it is a common belief that having open alcohol in the car or storing a case of beer anywhere other than the trunk/rear portion of the car is illegal. In actuality, there is no law prohibiting either.

However, open alcohol does give the peace officer reasonable and probable grounds to search your vehicle without warrant and possibly a demand for a breathalyzer test if the officer deems it necessary.

Now why do people end up paying these tickets? Unless the person fights a ticket, the court never hears about it. People usually end up paying fines because nobody questions the legal knowledge of officers.

It may very well be a new Florida law, but I wouldn't go by the officer's word alone on that.

As for your case, I would agree you have one. But, I'm sure the furniture company has one too. In all likelihood, the company's lawyers will attempt to settle. But if it is brought to court I wouldn't be suprised if the lawyers attempt to blame the accident on your sister. Hell, lawyers are so dirty at times I wouldn't be suprised if they insinuate that you should be suing your sister instead of them!

The reason I'm suspect is because the officer in question was already prepared to give your sister a ticket and at the least place partial blame on her. In Canada, it would be no question that both your sister and the truck driver got tickets. However, Florida isn't Canada obviously but that still doesn't mean that its not fishy when the officer says "oh yeah, btw your fine now cuz of some law". Officers are (usually) up-to-date with recent legislation because it is their jobs on the line.

Either way, the law is apparently on your side as you have an officer that can back you on the stand - and that speaks volumes. Just don't be suprised at the batshit insane things defence lawyers can come up with - especially corporate ones :)
