Desperate father in despair seeking advice

My ex is still restricking my visitation to only two overnights a month and isn't budging on this. My daughter turns 18 months this month increasing my chances of expanding visitation putting her into a 'new bracket'. For those of you that don't know she is 190 miles away from me and no this cannot be changed for a number of reasons. I have decied to kick my current attorney to the curb and will be dropping a shit load on some top attorney in the area(female). Any advice would be greatly appreciated.
 
My advice would be to move closer.. which is more important, your job or daughter?

I'm contracted in through a hospital for 10k for the next 2 years, plus the graduate program I want to start(which will triple my income thus making a better life for my daughter), isn't within a 100mi radius of where she lives. So it is not an option.

the courts determine visitation, not the mother..

if she refuses to release the child to you when you are scheduled to pick her up, simply call the police, have them respond, let her tell them no, and get it documented..

she will be in violation of a court order.. problem solved..

take away the power..

The court system shit's on the fathers in such an unimaginable way. They take up to a quarter of your income for child support without ANY monitoring of how it's spent or even being spent on the child it's inteded for. Half the time it's your own hard earned money being spent to pay off the very attorney's working against you. There is a movement by many trying to change things. It is a very slow work in progress though.

We have been broken up for about a year now. She has done entirely way too much damage for me to ever forgive her and is actively attempting to alienate me from my own childs life.

Spywizard, you are correct, however the courts are not in my favor or father's faor for that matter ie. one weekend a month visitation.

One would think they should as a mother SHOULD know better what is best for a child. But that isn't always true...

So now, having said that - allow me to tell you to back that thang up now.

Bitches come in BOTH genders. And I know of untold numbers of children who grew up motherless because their fathers were pricks that only cared about using the kid to fuck with their mother. Either way - the child is the one who pays the price.

Regardless of what he did or did not do to "piss" the mother off that shouldn't give her the right to keep him from seeing his daughter as long as it is does not cause hardship to the child. But who gives a fat rat's ass about the child, as long as the lawyers and "experts" are making money..... right?

I don't know what advice to give here because I am not in your life. And even if I were... the child is your daughter and only you know what course of action will be best FOR HER.

there are several nationwide mens rights in divorce and visitation organizations that will help, just do a search for one.. Most are non-profit..

I had police threaten to arrest ME when I had legal and physical custody and they did the same to my sister even though my daughter ran away from her abusive father and is in fear of her life.

So now... understand that if you live in topsy turvy land it doesn't matter what is right or wrong. :(

I motioned for full custody right off the bat and was denied without even a trial. The ONLY requisite they look at for taking a child from the mother is whether or not the mother has the capacity to love the child. They could be a whore working the corner and living in the projects while father is a respectable member of society living in a gated community and 9x out of ten the mother will be awarded custody. Shit is THAT backwards.
 
You get a good lawyer, you should get at least every other weekend, split the holidays, and you could get the bulk of the summer. Anything less than that and you got screwed.

Possesion is 9/10s of the law!
I got my daughter after the seperation, and by the time we went to court a year had gone by. They wont make a full custody change without good reason, for the mom or dad.

Yup, I belong to a couple. They have given some solid pieces to defend myself, but there isn't anything substantial. You see in case of custody trials the only offensive motion the father has is educated defensive tactics...that's it. It truly is a feeling of constant attack.

For the record I have done nothing to this girl for her to believe that our child shouldn't spend time with me. She is a creature that acts solely on emotion and feelings instead of logic and sense.

How healthy do you think it is for A BABY or any child to be shuffled back and forth such a great distance?

Think man... think.

If they lived closer and they got along on parenting issues then this would be proper but otherwise, sorry, the child should have ONE HOME. Just my .02

That's what I'm really banking on, my achilles so to speak is the distance though. I do work 12's and get blocks of time off so I'm hoping that will work in my favor to get her for longer periods of time rather than intermittent visits requiring a lot of traveling.

I set up a phone consult with this attorney, she's charging me 300 for a half hour phone consult so I hope it's worth it.

you don't need the mothers consent, it cost $100, they send a kit, you collect your sample via saliva, and a sample of the child, then the results are sent back to you..

my brother inlaw has been going through the same thing for 16 yrs now, and the kid isn't his, but he is all the kid has since the mother has 3 other children all from different men..

yea, child support pays the mortgage..

Thank God these words came from a man because if it came from a woman, especially me I would have been called every dirty disgusting name in the book and ya'll know it.

Bottom line is - only those parties involved can answer the question at hand and it isnt for us to decide regardless.

The parents live far apart from one another. Unless it can be proven (I mean REALLY proven, not just "She is a whore") that this woman is completely incapable of caring for the child then he has one of two choices - stay where he is and continue to see the child as infrequently as he is or he can move closer and get more time (which if they get along I think is proper).

I understand the reasons for wanting to stay where he can be better educated and earn more money. But he must also understand that he will NEVER get this time back.

I am not taking cheap shots. Just stating the facts.

I am really sorry that you can not see your daughter more.

3.)Very healthy, a few hours in the car for a child to develop a relationship with her father, PRICELESS! Cartime could be used constructively.

5.) Sorry, but every other weekend and half holidays is nothing like two homes. That is part time parenting.

It truly has nothing to do with control. This is my first and only kid and to say I love her would not even be enough to give my feelings justie for her. I grew up in a very solid household where both my parents were a huge part of my life and I have vowed to do the same for mine. PLUS there are many things I can provide for her that her mother cannot...such as abstract/structured thinking. Her mother is a flake with very little debth. The household is extremely void of structure, learning and independence...all of which I hope to instill in my daughter. That sir merely scratches the surface as to "why I would want to spend time with my daughter"

What does it matter if she is a whore??? are we still making parenting valuations on people's sexual preferences?? I mean if the custodial parent has a drinking, and or drug problem that endangers the child then i'm all for taking the child.. but sex??? No..

But i'm all for state run orphanages if the parent does not have the $$$ to support the child.. but we won't go there yet..

what if the custodial parent decided to move to the Florida Keys?? or cali and it wasn't 190 miles but 3000 miles??? what is to stop him or her??

The system is messed up, and needs to be fixed, but it won't anytime soon..

Well, I didn't get enough information. Did the court award you more visitation than 2 times per month but the mother is refusing to abide by the order, or are you upset that the court only awarded 2 times per month? If she is not abiding by the court order, just have your lawyer file a motion for contempt. If the court only awarded you 2 times per month, it may have been because the child was still so young that it was impractical for her to fly or make lots of long trips. I'm not sure. However, you should have filed a motion to reconsider the original ruling within a few days of that ruling, and if denied, filed an appeal. In Kentucky, you cannot file a motion to alter visitation for 2 years after the original order. I don't know what sort of time bar your jurisdiction may or may not have. Talk to your lawyer about it.

Otherwise, no reason to turn this into a Man v. Woman hate thread everyone.

some people don't have the $$$ to keep going back and forth to court, paying for social workers that will take a bribe and testify for the mother.. phsyc evals and the such..

1 time per month=first weekend (friday and saturday) of every month....that's it.

So very true, this is what my ex fails to see. We've had the best times in those car rides, singing and dancing to cheesy kidy songs. Hell I taught her to say the vowels during our last car ride.

No DNA test is needed, she is the spitting image of me. I can recall the exact time when she got pregnant as well. Plus I was only the second person she had ever been with so she is far from a whore. She made me wait about 4 months too

Well, you may have to wait a bit before you can get a modification. Just file your motion as soon as you are allowed to do so. Now that she is a bit older, you should get more. Standard is pretty much one day a week and every other weekend. There may be a bit of a battle because of your distance, but you should try.

I am putting in for another mothion seeing as though she turns a pinnacle 18 months in a few days. I'm getting a new attorney and going for larger blocks of time so the traveling isn't increased, just the time with her. I work 12 hour shifts so i get blocks of time of, which should help my case.

Well, good luck with that. It would be nice to have a good daddy who wants to spend time with my kid. Some women's priorities are screwed up. I don't know what the heck I'll tell my son about his loser dad.

Sorry if I sound a bit biblical here but really what is your #1 priority. I know someone mentioned it before and you made your case but it really still came down to money.

If you daughter is your #1 priority - get out of your current situation. You obviously found something attractive with her Mother - yeah she is the Mother of your child - so unless she has done something very serious, other than not giving head, you should really try to get back to that. You made that commitment when you had a child. Owne up - you are the Father and the best way for you be the Father 100% of the time is to be married to the mother. It is that simple - really.

This thread is the main reason I never had kids.
Having said that..........PDaddy, woman can be very vindictive when it comes to custody. I've seen my best friend go through this. He got good lawyers and now has his daughter one week on, one off.
His ex is still an unreasonable horrible person.
There is no good answer. I do hope this is resolved so your daughter doesn't get hurt. Good luck..........I feel for men in these situations.

It has nothing to do with being from Texas - I have lived overseas as almost as long as I have lived in Texas - and I am not talking about an abusive situation HR so back off. I am asking you what is so terrible about this woman that it would keep you from beeing a full time Father to your daughter.

You created this child - suck it up and do what you have to do to be the its Father.

pdaddy I dont know you situation, are you divorced? What was the reason for the break up? Im asking this to figure out why she is being such a bitch about this. People need to realize no matter what happened in the relationship if both parents are suitable to raising a child they should. Kids need a father and a mother in their lives for many different reasons. They both attribute different things to a childs development.

and I agree with that but when they can be salvaged they should and it is not necessarily from the kids standpoint (I was certainly a lot happier after my father shagged ass) but it is for his own sake.

I can tell you this - if he thinks he misses his daughter now at 18 months, wait until ages 6 - to 10 yrs. It will break his heart evry day he does not see her and what ever it is about his ex that bugs him now will seem trivial when those days come.

Look - I speak from experience here. I have been married 20 some years and 11 of those were when I lived in Bangkok. I am not saint - far from it and there have been many periods where I was not in love with my wife for sure. However, I think I could have continued a father /son relationship with my boys away from home but I could NEVER give up seeing my daughter.

That relationship is just too special and one should do whatever is possible to make sure that does not get put in the hands of the US courts.

when I was going through my divorce, my son was 2 yrs old. my atty told me that the judge would not likely consider ANY overnight visitation with the father due to his young age (2 or under). I told him that his Dad and I already shared the time with him about 60/40 so I would tell the judge that his dad could and should continue with the overnight visits a few nights a week. and we continued on that way.

so it likely has to do with her young age. get yourself a top notch atty and petition the court for whatever visitation you want. and go from there.
 
I really hate hearing about things like this. Considering all the deadbeat dads that are out there(like the one I sometimes deal with) you'd think that the courts would be a little more in favor of letting the proud and loving fathers be with their kids.

But I can tell you that you are going to have to do most of the work and the whatever attorney you get is simply going to execute what you have them do. You have to figure out.

I don't know your situation or what the courts that have jurisdiction tend to do - but as a father you definetly have a disadvantage. I don't know anything of the levels or plautaues that you speak of either (18 months???!???) wtf?? But that all seems like bullshit, but it's a reality.

You are going to have to figure out your own angles, your own tactics, your own strategies and you are going to have to FORCE your attorney to execute based on that. They will push back. You fucking tell them who is boss and how this shit is going to work.

Lawyers are fucking useless. This is your child, not theirs. They won't find the right angle... you will or you will fail. That being said, get a lawyer that is capable of doing what you need to do, one that isn't afraid to challenge you and one that isn't going to take you for a ride to beneifit their pocket book. (LMFAO @ finding that)

J: Once a month is an improvement to what it was. Before it was just one single overnight but it had to be in a fucking hotel room in Lansing Michigan because the judge thought that she shouldn't be too far away from her mother. How stupid is that.

We were together for about three years, off and on for most of the last year. When she was pregnant I sucked it up and sacrifficed my own happiness and she became my fiance, thinking it would be for the best of my daughter. I couln't have been more wrong.

A couple of months into the pregnancy I broke it off after it bacame painfully obvious that it would not work out. She had the child and I thought I would give it one more shot, I needed to completely exhaust that avenue before being able to move on. We lasted less than 3 months. The entire 3 months the baby was with her and breast-feeding. I put in for full custody and was denied without even a trial. So from there on out it has been attempt after attempt for more time.

What you said about the attorneys not finding the right angle and simply going through the mothions really hit home for me. I have been putting a lot of thought into this. My current attorney is a piece of shit. It's like he goes intot he courtroom with this laizai fair attitude with no real attempt to fight. It fucking kills me.

I will be hitting you up for any advice you can give to help

Do your research. Focus on the best interests of the child - if courts are receptive to anything, I'd say it's that.

Without knowing more than you have shared - I'd have to say your best angle is going to be arguing that it's in the best interests of your daughter to have both her mother & her father in her life and that studies have proven that children her age need frequent and consistent exposure to both parents to establish the appropriate bonds. Basically, it's do or die time for your child. It's best if they form these bonds NOW.

What's tough about your situation is that you two don't live closer and that you don't necessarily have a work schedule that allows you to have your daughter every other day and every other weekend - which is what every expert will recommend for a child her age.

That being the case - you're going to to have to figure out how you can get as close to that as possible. And get an expert to back you up on that and be willing ot testify if need be. Start out with getting finding the studies and case law that supports that - children her age need frequent and consistent exsposure to both parents.

You're entitled to a trial, no matter what. You can't be denied that to my knowledge.

I'm thinking about using this angle. I'm sure I can find a child psychologist to back me up on this and she fits every single one of those criteria.

In a perfect world I would say that your arguement is rational and sane, but unless he moves closer to the child he is pissing up a rope.

And as for your last statement - you couldn't be more wrong.

In topsy turvy world, there are no rules.

Hope it all works to the child's best interest.

It is truly sad when people treat their children like a possession and not as a human being. <---- that is child abuse and I will not rest until the law recognizes this. But that is MY gig. Not saying that this is applicable here. Just throwing out some food for thought because at the end of days only THE CHILDREN will be the true judges; something that all parents need to remain ever cognizant of.
