Brother got a 2nd DUI, need advice.....

Anyone have any experience with this?

He is living with me going to school, gets some state funding for living expenses.

Im worried as hell :worried:
 
Heres some advice... tell your brother not to drink and drive again.

It only took 1 DUI for me to come to this conclusion... and that was 10 years ago. The shit was just too damn expensive to risk it again :jenscat
 
a 2nd DUI? he didnt learn the first time? holy crap.

offer to give him a ride home at any time he needs one, and if he has a drinking problem, encourage him to stop. Other than that I dunno.

As far as I know, DUIs are the one thing people dont get off easy on. So I think its too late to revert any damage done already.
 
It depends on the state he is in, and also the DA pushing the case. In NY there is a DA up there that has a zero tolerance stance. Hopefully he will sober up and see the light.

Id have a sit down and talk to him and tell him you are there for him. I've gotten quite a few calls from friends in the wee hours of the morning asking for help and I've gone out and helped their drunk asses.

It depends alot on wat he was doing. A straight dui ill cause him some major headaches no matter what. time for rehab man.

he is 28, im 21, he dont listen to me much. My family has tried and tried to help him with his drinking many times. He knows he can call me for a ride. Fuck he called me last night at 4 in the morning to bail him out of jail. Im afraid that he will not be able to go to school next semester and that I will have to find a new roomate.
 
This is a very intollerant viewpoint considering more then 1/2 the drivers on the road where you live are drunk. Maybe that's why you have that viewpoint but it's interesting that YOU have that viewpoint

1.what was his b.a.c this dose have a lot to do with what the out come will be.did he blow at all because if he did not blow then he has a dame good case all ready.the d.a and the courts no its all most imposable to get a conviction on some one that did not blow.thats why they passed laws to try and fuck you if you don't.
2.now if he did not blow but he did take the field test thats what they are going to use against him in court.common mistakes made by the cops on a field test help you win in court.
a.doing the field test on a surface that is not 100% flat and free of all dabree
b.doing the follow the pen with your eyes test witch is no longer permissible in court yet cops keep doing it.
c.using the marked lane violation bullshit to pull you over.drivers are allowed to swerve
or go over the lines for many reasons and to a cretin extent it is permissible.cops are by law not supposed to pull you over for this unless you are going back and forth across the lines many times just once or twice is no reason to pull you over or if you go completely on the other side of the rod.
3.if he did not take the breath test and "also refused the field test"WITCH PEOPLE DON'T REALIZE YOU CAN REFUSE TO DO THE FIELD TEST TO.then they have no case against him at all besides them saying "I smelt it on his breath"lol what a case that will make.

so ask him about all that what he did were he was how was the roid serfice "also if he did do the field test cops have to give it to you with ether 1another cop present or 2
in front of the camera on the cruiser.

thanks need2, Ill wait till he wakes up to get all the details.
The ticket says he refused a PBT. But I think he ended up taking one cuz of the simple fact that if he refused it would be 2 years with suspended lisence - but it is an easier case to get out of if he didnt blow.
He was going down a wrong way street and where we live there are TONS of one way streets - city puts them in weird places just for the sole purpose of catching drunk drivers.

drunk drivers are right up there with domestic batterers & child molesters. another monster lurking.
 
A friend of mine has 5 DUIs, and literally has spent less than 30 days total in jail. Depends on what state, and how populated the jails are. In my state, they are way overcrowded, and dont have room for the drunks. I know he cant drive, but still does. And I dont think he can get his license back for at least 10years, but you have to pay some ridiculous amount of money now..Something like $2k to secretary of state!
 
It's all fun and games till someone get's their eye poked out.

Take him to AA and let him listen to stories, if he has already done that and won't listen. Fuck him and stay away before he fucks up your life too.

Tell him to quit drinking and driving like a fucking idiot. Pay a cab to take his ass around.
 
Tell him to go get evaluated at a state-licensed alcohol class and start the class now, well before he has to go to court. If he is resistant to it he is foolish the judge will order it for him and it looks better if he has already started the program.
Tell him to buy a bus pass, because his license is gone for at least a year.
Tell him to start saving his money because after he pays fines, Attorney fees, court costs, alcohol classes he will be looking at about $5k.
Tell him to stop drinking and driving.

That about covers it, except for the potential few days in jail up to over a month in jail, depending where you are located. This shouldn't affect his schooling, except for getting there (loss of driving privilages) and financial hardships brought on by the DUI.

If he's going to try to fight it at all he's looking at $10,000 at least, thats how much my DUI cost me when I took it to trial and won.

Need2's post above is correct. I refused the PBT, but took the field test (didn't know I could refuse) so at the trial we hired an expert to testify about how the field test is inaccurate and administered incorrectly 95% of the time. The DA ended up offering me just a 'underage consumption' ticket halfway through the trial if I agreed to plead so I did it up.

he saw a psychiatrist and got evaluated last year in order to receive funding for living expenses as long as he is doing well in school and stayed out of trouble. I think he will loose this funding.

The thing is that he moved out here to live with me and go to school with me so I can keep an eye on him and keep him in line. This was not my choice and is a role that I shouldn't be dealt. I have quit going out and drinking almost completely for him. But he got a job as a waiter/bartender at a brewery - i did not agree with this job decision -he makes the wrong kind of friends. The ones that like to go out and drink alot - outside the night life they dont hang out that much, these are the friends you dont want to have.

He is much older than me and doesnt really listen to what I say. But I have done my part, now he has to do his.

you can also get the charge lowerd to "driving wile impaired"its a lot lesser charge that cares no jail time and no lose of driving.you have to have blown no more then a .12 though as they just passed a new law preventing d.a's from letting plea out to this lesser charge unless they blew under a .12 but along with this new law they passed another law that if you blow over a .14 you are now mallitouse drunk driving witch carrys up to 10 years.

Sorry bro. DUI in CO first offense is a felony with mandatory minimum sentence 10 days in jail. I am experienced in it here. Depends on which state though.

I had to go to AA meetings - if anything they made me a very very bitter person. The premise which that silliness is based on is flawed.

Everyweek there would be people relapsing and shit...AA working wonders for you huh? The failure rate is extremely high for those 12 step programs.

I agree something has to be done - but AA is silly, does not work for most people.
