She'd really have to fight for it if he had it before they were married. She's only legally entitled to half of what they aquired from the day they got married until the day paperwork was filed.
Everything was mine before marriage, so my ex left with nothing.
She tried for spousal support, but:
1. She didn't file for it with the divorce papers, so the judge said if you didn't need it then, you don't need it now
B. We were married less than 10 years, so the judge said we probably never should have married in the 1st place
IX. Even if she wanted to fight for it, she'd only be able to receive support for half of our marriage.
Okay. Just please be careful. If she gets a lawyer and you made decisions now that you say are in the best interest of your child they will likely keep the status quo due to the best interest statutes of your state, which is Texas and is likely very pro-mom in divorce issues.
