I wish the supreme court would apply that standard toward their interpretation of the 2nd amendment.

Personally, I find it equally as bothersome as I've recently read that the Church is just theater. In essence they say alot of shit that is legal and meant to get a reaction. Once they get the reaction, they sue.
 
So I could single-out some random fatty (400lbs+) and follow him 24/7 screaming obscenities anytime he's in public (including work, if he works in a publicly-accessible place) as long as I'm 200ft from him?

By this ruling, fattie wouldn't be able to get that restraining order (maybe a very weak one, at best). My obscenities at him are political commentary on the stress that obesity places on our already overtaxed social healthcare system. It's political expression and we just learned 8-1 that it must be preserved even at very high costs.

Unfortunately, homosexuality is a political issue in this country which gives Westboro the highest level of protection under the Constitution.

The Westboro douchebags were obeying all the laws and the father didn't know about what their speech until he watched news coverage after the funeral; Since then laws have been enacted to limit protests near funerals in a number of states. I feel for the family but as Thomas Jefferson said, "Words neither break my bones nor pick my pocket."

The problem here is the singling-out of an individual (the dead soldier and his family) who has taken reasonable means to avoid becoming a public figure.

Now if Ellen Degeneres or General Patreus dies and they want to protest the funeral, so be it. If they want to protest the Pentagon, CIA building, White House or even their local military recruiting station, so be it.

I'd even say that if the dead soldier was unusually decorated or unusually publicized, this funeral may indeed be fair game for singling-out.

The constitution has to work both ways. One person's freedom to political expression cannot impinge upon another private individual.

(p.s. I do concede this specific case isn't a good one because the dad didn't witness the protest while the funeral was happening. They should pick another case and chase it all the way back to the supreme court)

also of interesting note is everywhere in the constitution, the phrase "the people" means individuals, but for some reason in the 2A it supposedly means a collective right instead of individual right.

Had Westboro just protested this one funeral then you would have a point. The fact they religiously protest at funerals means they weren't singling out this family. Maybe Pick3 should get his buddies together and road trip to every Westboro service and perform legal but lewd geigh acts in front of their church during service time.

I'm pretty sure the westboro douche bags do a little research before they protest a funeral....since none of them have been shot....yet.

Just based on statistics...most of those serving come from the middle or upper middle class.
