Argument with cop last night

Scene: My girlfriend and I coming out of the parking lot adjacent to her bar.

Cop: License and registration
Me: Officer, what did you pull me over for?
Cop: Soberietary (however the fuck you spell that...he was trying to say he wants to check if I'm sober)
Me: Did I swiftly change lanes or was my car moving in a way that suggests I'm drunk?
Cop: No, that's why I didn't give you the breathalizer.
Me: So what you're saying is you pulled me over to check if I'm drunk when it was obvious that I'm not?
Cop: Sir, license and registration please...
Me: Officer, I don't think you provided a valid excuse for why you pulled me over and I believe that is my right...
Cop: Sir, I already told you what I pulled you over for...
Me: (Interrupted him) So is this your thing, you wait outside of bars and pull over cars as they come out of bars?
Cop: yes, to make sure they are safe...
Me: I believe that's called entrapment...(I hand him over my license and registration, ensurance papers, etc...)
Cop: He comes back and says your ensurance is expired but I reduced your ticket to 65$ instead of $120...
Me: So....let me recap. You pull someone over outside the bar, even if they don't give you a reason to and you try to find something on them...and since you are doing this every night right outside of my girlfriend's bar, that's not only entrapment but harrassement as well....what divion do you belong to? is your badge number on the ticket?
Cop: (stutters) yes, all the information is on the ticket....
Me: I'm going to take this to court...
Cop: if you want, I can make it worth your while and give you the full value of the ticket...
Me: So....now you're blackmailing me? I'm going to take a ride to division (censored) and submit a compliant with your badge number based on harassement, entrapment and blackmail....how's that sound?
Cop: (shocked look on his face) silence...
Me: Have a good night officer...
Cop: Good night...

I drive off....

You need Probable Cause to justify why he pulled you over to begin with. It can be for anything from an equipment violation (Exp registration, brake light out) or a moving violation.

Once that is establish, if the Officer believes you to be Under the Influence, he can check your sobriety. BUT he has to have and give you a reason why he pulled you over, being near a bar DOES NOT give Probable Cause to check for sobriety.

Now, if he watched you stumble out of the bar and get into your car, that is enough Probable Cause to pull u over to check your sobriety.

Fight the ticket, you will get out of it

I don't know about Canada, but here in the US cops pull you over for any reason they see fit, and complaining to the department will get you nowhere. You can't claim entrapment by police staking out a bar around here either, since they set up major roadblocks and DUI checkpoints in random spots of every major city on every holiday and weekend.

Our company Xmas party was held at an Indian Casino this year, and the Valley Center Police Department set up a DUI checkpoint about 100 yards down the road catching people all night long.

Being a dick has everything to do with it. I'm sure quite a few drunk people drive home after being at her bar. He is just making sure people are safe. Had you not had to complain about it you most likely would have been on your way in a few seconds.
 
I have never fought a ticket, seems like it is giant waste of time just to save 100 bucks or whatever.
People have told me to fight tickets before, fuck that.
There's always going to be people who it and I am glad they do, just not for me.

that's not true. it's the safe cop that pulls over the bar's customer everyday...and in canada, a cop is not allowed to do that....i dont know about the US.

$100 bucks? Damn, either you haven't gotten a ticket in a while or we get seriously ass-raped here in CA compared to NY. Got a ticket from a traffic camera a while back for $971.00.

When I was a kid I got a 300 dollar ticket for parking in a handicap spot.

People are fuckin idiots and I would much rather be pulled over from a cop checking people leaving a bar than someone I know get killed by a drunk driver. Bro, I'm not a cop hater. Half my friends are cops....it's cool...I just don't like arrogant cops who pull you over "looking" for something...he had no legit reason to pull me over and he was being all patronizing with me...I wasnt going to have it. I might be arab, but I pump Canadian bloob, proudly, and I have rights just like anyone else. He can kiss my ass.
 
Downtown in my city cops will be next to the bar/entertainment strip of town but they do not pull people over unless they are tipsy, having that cop constantly do this only in her bar could actually drive customers away from her business so it's good that you mentioned it, her customers can feel harassed.

How do you know what they stop them for? You don't, and I bet they stop a lot of people that are sober too.

CA is expensive. My very first ticket was in 1994, I was doing 82 in a 25 zone, driving along the beach in Carlsbad at 2am. Cost just shy of $1200.00.

I got out of the $971.00 traffic camera ticket, since I didn't run the red, I was inching around the corner in a right turn lane and the camera took my picture. but, it still was bullshit taking the time to go to court.

My 1st traffic camera ticket was probably around 1996 and it was for $371.00, plus an additional $30.00 to the courts for the privilege of taking traffic school and another $25.00 for the school.

because the next time they come into the bar, they talk about the same cop pulling them over every damn day and it's like harassement and it's getting annoying coming into the bar, etc...

He parks literally right outside the bar....and as soon as a car leaves the parking lot, he turns on the sirens....I'm pretty sure there's something wrong with that...

I'm not but I have a lot of cop friends BBMed one and guess what they are with in there legal right to do so. Drinking and driving is not like other laws reasonable suspicion is all that is needed. FYI driving is not a right it's a privilege that's why you take a test etc. You got a mighty big chip on your shoulder dude need to get it in check.
 

Double cause I checked with two diffrent guys they both said about the same thing. They can pull you over for anything check if you have a valid liscense valid insurance etc. One dudes got close to 20 years on the force and the other like 10 so pretty sure they know what they are talking about.

btw: cops don't need PC in certain aspects like DUI checks outside popular bars. No different then pulling over a mercedes in a drug neigbhorhood.

Perhaps it's an area with a lot of incident calls, and his department has stationed him there.

You have no way of knowing if he is exclusively there, or if other flickers aren't near other bars as well.

if you have 2 equally nice bars by your house but one of them has a cop parked every night who will stop people 2 out of 5 times, wouldn't you prefer to go to the one without the cop? I'm just throwing numbers out there, I dont know how often he pulls people over, and I'm not saying people are or are not breaking the law, but if you are tired and done for the night, even if you are not intoxicated, dealing with a cop is time consuming when you are tired and trying to get home, it isnt fun...

Wouldn't bother me a bit. In my experience the only people that have a problem with cops have something to hide.

Sure there are pry some officers out there that tarnish the image but Jesus fuck the guy is just doing his job. If you're not doing anything wrong you have nothing to fear.

Cop will talk with all his good buddies on the force, and inform them that if they ever see (insert your vehicle description here) bearing license plate (insert your license plate here), be sure to nail Traz even for being a little over the speed limit or for whatever minor infraction they might witness. This is how cops generally deal with people they perceive as being 'difficult'.
 
all I got from this thread was.....I agree with plank (wtf) , get a cab, and it didn't take long for traz to replace the wife (is that an "atta" boy moment or not..Im not sure)
 
Just returned from the Regal Beagle. Mrs Roper was playing darts for a while, trying to avoid Stanley. A new bartender named Bob was working. Jim must have had the night off.

I didn't read any other posts, but if you're driving uninsured it's a misdemeanor in the US, at least (or in Utah at least I should say). Cops have scanners on their cars here that hit basically every plate in front and behind them and that shit can come up. But if he had no real reason to pull you over and none of the scanner shit came into play, I can't imagine you'd have to pay.

You should have shoe bombed his ass.

oh and, if you're not a lawyer who's an expert in civil/constitutional/whatever-the-fuck-kind-of-law-it-is, you probably should keep your theories on profiling and entrapment to yourself when johnny law is just running a general check on your documents...especially if you venture south of the border...eh.

i've done it both ways when approached, taken the fuk off stance (got my ass slammed to the ground and was all black and blue) and capitulated right away (treated with respect, no cuffs, cop let me walk on a stout misd.)...the latter works a hella lot better imo

well i just go it dropped...I was right. Called a friend of mine, a cop, and he said that cop was just being an asshole....he talked to him and the ticket is in the bucket. case closed.
