Unemployment question.

What up homies, I’ve been working since I was 13yo, I’m 29 now, been working with this company for a little over a year now. Another company is buying the branch that I work at in July, so my options are to relocate to Seattle (don’t want too) with the company I’m with now, or quit the company I work for now to stay with the company (shitty company) that is buying out the branch I work at now, here’s my question, is there a way to do neither and collect unemployment for 6 months or so? Technically I’m not quitting, the job I’m doing is ending and I would be forced to move to stay with them…anyone know the laws on this?

sounds like your current position is still in place but it would be with the new company who is buying the branch so it doesnt seem like youre actually getting laid off
 
yes but it's with a totally different Co. can you get unemployment if you quit? or do you have to be fired or layed off?

big bad buff, you have to understand, MM69 is not very good at clearly expressing his thoughts. as a result, sometimes his posts are hard to understand
 
read into it; if you quit you cannot collect unemployment and in 99% of cases if you are fired you cannot collect.

as I said, figure out a way to get laid off.

personally, I would never consult with HR on this - they are not working in your interest - they are working in the interest of the company, thus they will want you to quit.

oh, and they will document your discussion, just in case you get fired (they won't pay unemployment).

It's not up to the company if they pay unemployment or not, it's up to the state. The employer can protest unemployment but they have to have some kind proof, "oh he came and said this one time" won't be good enough for the claim ajudicator. I would just ask them how they will classify the termination if he doesn't relocate.


But yeah, they will do whatever they can to have you resign before firing....
 
yup thats my point, of course its not up to them - if it was they would never pay (except executive staff)

in pa, it's supposed to be for lay-offs only. . .if you quit or get fired, you're not supposed to get it. . .however, most people file anyway and most companies don't fight it because the hearing process is a pain in the ass. . .some of my clients have fought it in the past. . .the results were 50/50 at best. . .the judge or lawmaster will usually grant the unemployment to the person regardless of the circumstances. . .the laws are very clear (in pa) but their application is very liberal. . .
 
Seattle is awesome, why would you not want to move here lol... It never rains.
 
force them to lay you off. moving your job to seattle is not a viable employment option.

don't "quit".

Just tell HR you won't move. Nothing wrong there.

If they offer you another position and it's a big pay cut (has to be a certain amount) and different hours (not sure if one or both criteria must be met) then you are entitled to refuse the new job and collect unemployment. At least here in Texas.

MM hit it on the head, unemployment laws vary from state to state however it is a universal rule that if you quit you cannot collect. If your company was sold and your job moved out of the area then you will be able to collect based on the fact that your position was eliminated. Like MM said, speak with your HR representative and see if they can write a letter to the commission explaining the circumstances. Good luck and God speed with a new position..

exactly. If you quit and go file you will have to go through a big claims process and u wont receive for quite sometime. where as if they lay you off you will only have to wait a little bit, then you will be able to collect.
