Taking My Former Doctor To Court

Now before anybody goes off about ethics it's only for attroney fees and less than $ 4,000.

1. Doctor broke patient/doctor lines of ethics by sending me pornographic material that I asked not to see. Supposed material taken off my partners computer.

2. Pornographic e mail with attachments had a made up e mail address of fagchris@.... She had an employee send this material on her request though she denies it.

3. She told her attorney she did not do this and he told this to my attorney. She was asked by her attorney to give him the files on disc which she did. Those files which where requested by my attorney matched 100% what was sent to me proving they came from her office.

4. Not only did I lose my doctor over this she blantly tried to ruin my relationship with Chris by sending me materials I said I did not want. I have her personal e mails to me offering the material and my response back to her asking not to see it.

5. She forced my life into her employees hands by allowing them to ridicule me at my exspense.

Am I being unfair?

Nordstrom my dilema is I thought she was a great doctor and more so a friend. She framed Chris than tried to ruin my relationship if some recall back it almost did. She on her own turned physco on me by doing this. She involved her employees in my personal life with Chris and there hate for him and me came accross with the fag address e mail. I have never ever sued anyone and have filed a claim against 1 doc for operating on me while i was a wake and begging for him to stop. In response he pushed down on my head and gave me more drugs ( to late). He later said he was at a delicate point and could not stop and underesimated my anesthisa. I did not sue so it shows that I am not sue happy. She and her attroney have been given a month notcie and have not gotten back to my attroney thus they think I am bluffing as I have name notieatry in Austin and they think I won't out myself or two they think I have no case.

ah she framed him? i thought it was a misunderstanding. If she framed him intentionally to break you up then that would be different.

You suffered from anaesthesia awareness (which is what its called when someone isnt given enough drugs for surgery)? shit, have you gotten any help for that some people get PTSD pretty bad from it.

i was mentally fucked for months. got over it as i do everything but i think back on occasion. i went to the doc to talk about this to try and get it off my mind as he was cutting me. he apologized and because of my size did not give me enough anesthia until it was to late. it was an honest mistake i guess and the complaint was enough for me.

What she did was extremely unprofessional. I always question people suing doctors for 'little' medical things, so to speak, but that does not even apply here (disregarding your surgery post completely). What she did was so far out of line, I would go so far as to say that she SHOULD loose her licence for that. Is she a general practitioner... that deals with families and children? My opinion from the information presented: I agree completely with ohashi.

Chris can't sue. Part of this is he had to sign an agreement as did they that they would not go after each other as he did some things he should not of and so did they. I am keeping this about me as to not open his case up which they may try to do. She was amking me aware of what kind of person I was with. ( what she said to me in person have no proof). Funny thing is there is no case like this on file that my attorney can find and she may not have broken any ethic codes either. I have done a search of the codes and can't find one and my attorney says we will play on the jury if need be. We both hope they will settle as it appears she has much to lose.

depending on your State Statutes, she might be able to claim you verbally asked for this stuff and simply lie her way out of this.

I used to work as a Physical Therapist and Athletic Trainer and I cannot think of one instance where I would act like she did. It's bizarre.

GotMilk your right and I did go down to her for an appoinment ( necessary) and we did discus how this would impact our relationship as doc/patient. I did not want to lose medical care from her and she was afraid of what Chris would do and how she may over treat me as to not upset Chris. This is when she dropped to me there are things you may want to know about Chris. The rest was the e mails.

Should she play this angle I think I could prove she lied and made stuff up as she still denies sending the porn which matches what she gave the lawyer so this could prove mentally though a doctor she has issues.

Lastly I don't know why she did this. She may have over estimated our "friendship" and thought she was protecting me or she hated Chris so much she wanted to see him fail in life as she knows it's me who makes the money and provides his lifestyle.
