Yep. Just got served. Guess they want me to testify against my neighbor and his criminal activities.

I'll be moved out of there before the trial I hope. It's a rape case, so I doubt he'll be convicted. I wonder if I can refuse to testify...
 
I did and I've been living by his scrawny punk ass this whole time. I don't think he'll do anything, honestly. It's just more time off if work and a great big pain in my ass.

I won't recant. I wast thinking more along the lines of telling the prosecutor that I have a couple of kids and am concerned for their safety. I dint know what good it will do thou. I don't think the DA give a shit.

Weren't you also up all night the night before, and in fact, quite tired at the time of the events in question?

I heard him break in, then she stared to scream. I heard what sounded like them fall on the ground, then she screamed for him to stop and not to rape her. She kept asking him what are you doing? Then she screamed that he was raping her. That's when my teenager flipped out. I was already calling 911. My son tried to go our the front door and I grabbed him. So he jumped on my bed (the attack was happening above my room) and he pounded as had as he could on the ceiling.

That's when the attack stopped. I heard the guy run down the stairs and I saw him running down the sidewalk.
 
V so the victim was still there when the police got there and you saw him run away from the apartment? So, he broke in the apartment? Oh, god I'm so glad I have an alarm system. I would think he's been on community control or something before so they prob have his DNA and he might get convicted. Your teenage son flipped out and tried to go to the door to save her? He's going to want you to do it I bet. That man needs to be put away.

I'm glad you got out of there.
 
First of all, holy shit do you live in a trashy part of town. Secondly, if that were your mother or sister being attacked wouldn't you want someone to help put him behind bars? If you're so concerned about your kids well being WTF wouldn't you a) move and b) take deadbeat dad to court to collect on some fucking support??

He broke into the room. Like she had locked the bedroom door and he kicked it down. And yea, he ran from his apartment. The property manager told me that the woman wasn't on the lease, that it was his place, but that woman lived there with him and two little girls from what I could tell.

He was gone when the cops arrived. They knocked on my door and I told them what I heard and what I saw. I knew it was the boyfriend so I asked the officer if he was really raping her and he nodded and just said that the woman was really shaken up.

Her screams were awful, my son told me later that he just wanted to get them to stop. He figured if the guy knew people could hear it, then he would quit hurting the woman.
 
He's probably been arrested and is on community control right now until the trial. I'd find out more details of course but he could even be in jail still awaiting trial and has not made bond yet, or if he has, he has so many restrictions that he can't move an inch. If you're charged with a violent crime like that usually they'll put you on house arrest until trial. Not sure how it works in your state though.

Sounds terrible. Ugh. I feel bad for the victim. Hope the girls were not there.


That reminds me of a book I read/movie I watched once that stuck with me. Have you ever seen the movie or read the play "For Colored Girls Who Have Considered Suicide When the Rainbow Is Enuf" or something like that?

Obviously I wouldn't want something like this to happen to any woman. That is why I called the cops and why I answered the door when they knocked. What I didn't expect is for him to be back in the apartment within a couple of weeks. So before you go on about how I should stand up and do the righteous thing, understand that his victim let him back into the apartment and continued to live with him.

Second, moving costs money. I don't have a truck or a friend with a truck, so I have to rent one, deposit, costs of setting up utilities. It all adds up. When this happened, I had been at my place 3 weeks, they moved me to another set of buildings on the complex, but comped me nothing.

And the child support thing is a process. There are consequences for him not paying it, but he doesnt care.

If he is supposed to have restrictions and stuff, why the heck was he back at the apartment? ?

This is why I was really surprised to get the subpoena. I didn't think any charges were pressed.

Unfortunately, Cindy, the girls were there. And I've never heard of that book. What is it about?

I''m a CNA, but for the last 6 months I've been in tech support. It paid a little more and I really needed a job.

I was just offered a job at a level 1 trauma facility thou. I should be starting there in the next couple of weeks. It's a teaching hospital, so hopefully I can get some help with school.

I guess I'm going to be working two floors in med/surg, telemetry and eating disorders.

This is a domestic violence case, not a murder case. I know there will be no protecting me and the boys by the authorities. I was thinking if I can move before the trial (I'm headed way across town if I can find a place I can afford) then I will absolutely testify.

At this point it is more important to get your kids in a safe environment than being a stubborn bitch with principals.

Because it is his apartment and he is probably on house arrest, which means he was able to make bond; that sucks. But maybe not, maybe they don't take that stuff seriously in your state. Have you seen or heard him coming and going freely more than twice a week? You still live there? For some reason I thought you moved.

It is about a lot of stuff, but it reminded me in particular about a character that was dealing with domestic violence and rape with her two children in the home.

I don't live in that apartment anymore. I was there for maybe a month longer and I told them to get me the hell out of there. I got a strange note put under my door and when I showed it to the office they decided to move me. I'm about 4 buildings away now.

I only see him sometimes if I go to the office cause he lives right by there.

Get a lawyer! If you're in fear of your wellbeing, you have certain rights, and a good lawyer from your state can help get you out of it safely, and without being in trouble with the law. You must respond to the subpoena though, or as Nangiggles says, you can be charged with contempt and be arrested. If you aren't in a position to get a lawyer, call the DA (or to the defendant's lawyer; whichever got the subpoena), and go talk with them before the court date, so you can find out what they want you to say, and try to make a deal with them yourself.

This was over 10 years ago so I have a hard time remembering a lot of it.

I was sitting in the back seat of a friend's car while she ran inside. This man comes up to my window...he says some things and I get scared and try to get out. He pulls his gun out and tells me to stay in the car. Sometime he pulls me out. That is when he tells me he's going to kill me. He says things like think about your family because you'll never see them again. You'll be dead tonight. You'll be in the ground in a couple days. He was insane. I really thought I was gonna die.

Cops show up and that goes on for while but, I didn't die. Lol.

It can be intimidating but such a slow rate of fire if a criminal it quick and stupid enough to keep pursuing. Then if she ever did have to use it the mess left behind all over the wall/ceiling/floor might make her want to move again. Although rock salt could be an option. I'd still get a nice semi auto .45; has stopping power and it's quick.
