So I got charged with Malicious Mischief in the 3rd

A gross misdemenor.

I wrote about this before on here but I'll repost the details:

Drunk with my ex-gf, we get into a verbal argument upstairs, she runs down the stairs and says she's leaving...I don't believe her. I hear the door shut downstairs and realize she actually is going to drive drunk. I run down the stairs and get outside just as shes backing out of the driveway. I bang on her car yelling "no dont drive!" and i hit her windshield and broke it, and she drove off.

They pulled her over for DUI on her way home. When they saw the windshield they arrested me.

Booked me on Malicious Mischief in the 2nd with domestic violence, $50,000 bail. Totally ridiculous. This was on a friday, I bailed myself out, on monday they dropped my court case from superior court. 2 months later now I get a notice from municiple court they're charging me with Malicious Mischief in the 3rd (gross misdemenor).

I think I'll be ok because to prove this charge against me they have to show my actions were malicious which is hard to do given the circumstance. The ex-gf is not going to try to bury me or anything, she got all her DUI charges dropped so she has no bitterness. They haven't even called and talked to her.

I have a 100% clean record, should I be fighting this? Or trying to make a deal?
 
k ive been in a few altercations with law the best thing is to find a good lawyer that does not meen expensive get a lawyer and that is 90% of the battle i garantee yhou i'll never go to court again with out the proper representaion but thats my opinion bro!!
 
$50K??!! Dang! Get yourself a good lawyer. . .if your story is true and your GF is willing to corroborate. . .you should be able to walk away from it w/legal fees.
 
ex-gf will definitely corraborate my story, although she almost doesnt have to...she got pulled over for DUI...its on the record.

50,000$ bail was so insane, worst part was my entire family was out of town and the jail can't call cell phones so if not for 1 friend, i would have been stuck in jail and nobody would have known where i was. i would have missed my sisters wedding!

Get a good lawyer. . .now is not the time to skimp. :)
 
How the hell did she get her DUI charges dropped, but their charging you. Did she tell them you were threatining her and she had to leave? Doesn't seem to make sense

But lol @ their being a mischief charge. If you go to jail don't advertise that conviction.

Tell then you killed someone instead.
 
They dropped the charge because she blew under the limit at the station (after blowing over in the field test) and the circumstances (windshield breaking) confused the prosecutor, she even said so.

Are you sure she didn't blow something else at the station, too?

Wow... you are lucky she didn't get prosecuted for the DUI. If she had, a slick defense attorney could have had her say: "I didn't want to drive but was so terrified of him that I tried to escape. He busted my windshield screaming 'I'm going to break that window and rip your heart out' while I sped away your honor!"

believe me this has crossed my mind. however, as evil as she was (chronicled in other posts..search for "broke up with my girlfriend" or something like that) she wouldn't have ever done that. but yea, its very nice to not have to worry about her trying to bury me, her case is over.

No I was fine, I had been drinking much earlier in the night but I was fine at that point. I guess I hit it hard. My hand was totally fine, just a couple of small cuts no stiches or nothing...actually the worst part was the bruised knuckles. I didn't even know I had broken it really until they told me. I saw it later, and it was pretty messed up so I really did a number on it. I was just scared when she was leaving and I whacked it pretty good.

No disrespect as I am not on the jury. But I simply don't buy the story that you were so riled up telling her not to drive drunk that you broke her windshield...

I don't think a jury will either...

maybe you are not aware of how easy it is to break a windshield...i didnt go THROUGH it...baseballs land on cars and break windshields all the time, it doesnt take much.

and besides they dropped it from superior court for a reason, the domestic violence aspect was bogus.

BS....it takes ALOT to break a windshield with your fist.

i really dont know what you're trying to imply...my EX gf who has no reason to lie for me, we're totally totally over, says the reason i hit the windshield was because i was trying to stop her from driving drunk. go away little man.

i saw the movie. also, it's one that moved me. i saw it alone in the theater and I cried. also, i saw bon jovi in august 1989. it was hot as fuck out and there was a tornado or something and one of those big huge screens that hangs over the seats actually fell because the winds were so fierce, whatever was holding it up, snapped, and the fucking things came sxwinging down into the crowd and almost hit us. then it took 1.5 hours to get out of the parking lot as most people's rides were stuck in what was now a huge pile of mud. good times though

you go to theaters by yourself too?

i havent in a while but yeah, why not? especially if i know it's a movie where there will be tears shed. if i go with someone to a sad movie, i end up having to hold in the tears or hide them and thats so uncomfortable cuz its not easy (although Ive become quite skilled)

you know what though? I have a girlfriend, lots of friends, you know I'm very actually popular I'm seriously though, popular like candy. but the other day a few weeks ago it was Saturday and I really wanted to see Superman. yeah Superman! and I knew it didn't have long in the theaters remaining, I mean he's superman but he's not God ya know, eventually he'll have to leave the theater, even Jesus had to with all that Passion eventually. so I just went. just by myself and I told people I did it. hell you don't talk to people during a movie anyway, it's rude for christ's sakes. shit you shouldn't even be allowed to go to the movies with people you know, then at least all the hooligans wouldn't yell to impress their friends. so they said wow that's really weird and I said yeah, but you're my friend. all this makes me think abotu the guy in this thread who got charged with a crime. man. that really sucks. 3rd means that you passed 2 other degrees of malicious mischief thought right? might want to tone it down, keep it to 1st or 2nd degree bro. just some advice from a fellow god bro.
