Should companies be allowed to have a "Look Policy"?

Here's a fun one for you knucklheads to debate over. Is it illegal for companies to have a 'look policy'. ie: Only hire people who fit a certain look or put others who don't fit the 'look policy' into specific positions.

[Abercrombie] hired her unaware that she had a disability, however when they were made aware, within 6 shifts, they removed her from the shop floor and wanted to hide her in their stock room because her prosthetic hand was breaking their "Look Policy". [...] her minor imperfection was repeatedly pointed out by various staff members who harassed her for wearing a mini cardigan (which she was instructed to wear over her usual uniform). After only her 2nd shift on the shop floor, she was told that they could not have her being seen on the shop floor, as she looked different to everybody else and asked her to report to the stockroom while they found a replacement.
 
i have a friend that works at a weight loss counseling center. they force them to stay at a certain percentage of their ideal body weight, otherwise they get a write-up, and X number of days to correct it. if the management doesn't think their hair or makeup is "pretty" enough, they suspend them and send them home, docking their pay since they work on comission. didn't think that was legal to do, but it's been going on for years. :confused:

In some places (like our office) it doesn't matter (phone work, here all I care about is how you sound on the phone). But if you are talking about a place like BoneDaddy's (AWESOME BBQ place in Texas) it most certainly does! If the applicant doesn't fit the image or attitude she doesn't get hired. Simple Shmimple.
 
yep. I have a friend who work at Hooters for years. She said when they call you in for the interview they sit you on a barstool. If your ass hangs over the side of their barstool whatsoever, they will not hire you lol

companies do this all the time, nothing to see here move along. Im guessing its no coincidence that the Sams Boat down the street from me is populated by nothing but hot coeds with tight daisy dukes on.

Forget about retail. What if I ran a company that doesn't with the public. Why can't I hire people and banish people to other areas if they don't fit my 'look policy'. What if when I invite clients over, i don't want them to see fat people at desks as soon as they walk in? Can a 'only public oriented look policies' law be even implemented? What defines a 'public business'?

I work in Hollywood. Fat ugly people don't get hired point blank for most positions. Is it wrong? I don't know but if you're fat or ugly, and your job doesn't involve technical skills, don't come. (btw: playboy doesn't employ fat women for any of their positions lol).

Those employees are "grandfathered in". New employees all have to be attractive. Attractive employees who get old are moved to the upper offices. So when you walk into the playboy offices (or hustler) you don't immediately see middle aged fat chicks at their desks. It's like this at madison ave and companies in the art district as well. Image is everything.

I really dont see what the big deal is. Attractive people have been getting ahead more than others simply because of their looks since the beginning of time. Thats like asking why dont strip clubs hire fatasses even though they know how to work a pole.

Different strokes for different folks.

Coming from a long line of self-employment I firmly believe that any company should be free to hire/fire whomever they want/whenever they want. If that company hires their employees based purely on their looks then they won't be around for very long, regardless... right?

Life isn't fair.
 
I have to admit, when I was younger and in a hiring position one of the first things that ran through my head when a female applied was "do I want to see her in front of me every day?"

I did not hire one girl because she was overweight and unattractive, and ended up hiring the cute young blonde, who ended up banging another manager her second week and getting fired.

You mean like asian airlines, modelling agencies, hooters, victoria's secret, playboy, hollywood studios, casting agencies, velvet rope dance clubs, corporate PR positions, strip clubs, massage parlors, gay clubs, cruise lines, etc. etc. etc.

Private Sector isn't nice to fat people, especially females. They always get the crappist of jobs (hence why many flock to govt jobs as a result). This is not going to change ever and yes I will hire based upon looks also for non-skilled positions.

I don't want my new company to be known as the company of fatties and uglies.

Sure those jobs will always have people get shitcanned for performance reasons, but those people would have never gotten the job unless they were hot in the first place. You will never see an ugly/fat person get fired from a job like that because they wouldnt ever get hired in the first place.
 
I had this explained by the regional HR for the northeast at ANF. In so many words... Ugly is not a protected class.

my girlfriends job is like that. they are huge on image. shes 5'5" and 130lbs and they tell her shes overweight but in reality women would kill to look like she does. they always get on her about stupid shit like eyebrows and skin tone... right now shes in Vegas for a trade show with her company and before she left they gave her a lot of shit about how she looked even though i thought theres nothing wrong.
 
I have zero issue with it. A brand encapsulates every single interaction you have with it, in any way, shape or form. All 5 senses.

The dry cleaners I go to - they don't clean my clothes any better than the old Koreans down the street. They do, however, employ several young italian girls who aren't shy about rocking the wife beater and velour sweatpants. If they suddenly switched to fat housewives my affinity would go right in the pooper.

There is a reason that every pharma sales rep is a hot woman. Even when I sold photocopiers they would never hire a woman that was not in good shape and somewhat attractive.

lol thats definetely true about the copy machine biz, I worked in it for 8 years and every female sales rep was hot. And even the lone female repair girl was hot lolzzz.

If you ran a company who's main business was on the phone, you should do a prelim interview by phone. If it's image oriented a photo should be attached to the resume. Why do modeling companies start out with a review of their portfolio?

If I run a fashion marketing firm I can't legally hire attractive people but the gap down the street can? You either allow all businesses to do it, or you can't. Unless you want to organize the 'ugly police'.

WTF are you talking about??? I think I was pretty damn clear. I don't care. The chick with the missing arm will win money or settle, right or wrong, that will happen.

Companies can and should choose employees who can benefit the company. If you're the one hiring and you screw up like this A&F example then there will be consequences because of it. If she wasn't working out as an employee she should be let go. If the guy who hired her wasn't following his directives he should have been let go.

I wouldn't be surprised if they knew each other prior, he has a new job lined out and hired her so they could bring a law suit against A&F and split the take.

Business is full of harsh reality.
 
Some people have a talents and others do not. If somebody was born ugly and has difficulty getting a certain job because of it I don't see it as much different than somebody being born stupid and not being able to get a certain job because of it.

Um, the police have nothing to do with civil rights cases (unless they're the alleged abusers). Police don'g go into business looking for employment discrimination. There are no employment discrimination raids, lol.

If someone thinks they're fired or not hired because of some kind of discrimination, they need to file a complaint with the EEOC. The EEOC then either decides to take on the case or sends the complainant a "right to sue" letter and the complainant can then bring their own case.

And Moose's boss is right, "ugly is not a protected class."

I think by "police" RG means any legal or government agent. I'm sure he is reasonable enough not to expect some flat foot to walk into a place of business and execute a warrant for discrimination.
