Refund rant!!!

I ordered something online for a little over $350. The place I ordered from is fairly reputable from all my research. After placing my order I called and checked on the status after 4 weeks, and they said they custom build this product instead of having them in stock so it will be 8-10 weeks. That was fine, since it is a small company I understood. I waited 16 weeks before contacting them again, and the guy said that he needed to check with his welders. After not hearing from him for a week I contacted him to cancel and refund my money, that was two weeks ago.

My question is since it was on my bank check card can I go through the bank and have them deal with him? Or do I need to talk to Guido?

I think there is a limit to how long you wait before the bank says "not my problem anymore". Here is 30 days (you have 30 days to tell your bank: Reverse the charge).

16 weeks is a HELL of a long time, you might be out of luck there

Transactions over the phone are not valid in court because the signature on the slip does not exist therefore the transaction is not mutual. You can call and do a charge back saying you never ordred the item. It doesnt matter if you did or not. They will credit ASAP then check on it. I work for an online company and this happens all the time.
I even have people who order and sign for a ups package in their name. If they charge it back we still lose in court and that has been for thousands. My company is very large as well so its not like we have cheap representation.

call the bank and get a credit

Call them back, be very nice and ask them what the lead time will be at this point and remind them when you ordered the product. Then ask to hold if possible while they find out the lead time, if you can't get anywhere with that ask that person's name and tell him or her that you expect a return call within the next 24 hours. After that time tell them they can expect court papers delivered to them. Then go to Small claims court and fill out the paper work and you should be on your way.

Do you have anything in writing as to how long the product would take to produce?

That must be one helluva penis pump if they have to weld it.

I have the order receipt, an email asking about the status, and his reply, then an email asking that the order be cancelled and a refund, and his reply agreeing to cancel it.

I'll try calling them again.
