I feel for you. Man, I dealt with 2 evictions in my last property. Both tenants had marginal credit (pulled credit report legally through a landlord's association), but big deposits so we thought we had it covered for the most part. Both ended up trashing the place to one extent or the other, and each owing about $6k. Took them both to court and won structured settlements each time. Quite a ride, though.
Feels so damn good to get them, but it sucks big before that.
Where I'm at, you can put stuff on the curb once the sherriff has been present for an eviction. Did that once.
Buglary is criminal, not civil. If the police are telling you that, then TO ME that means one of two things: 1) they don't want to deal with your problem and are lying to get you off their back, 2) they don't wnat to deal with your problem and, in effect, are saying YOU deal with it and that'll be fine by us. Of course, that is speculation.
Part of me says hire DIV's guys -- that is justice to me. But the rational part says take their stuff to the dump, and hire the guard and get a dog. Then you can get them on attempted burglary and criminal trespass -- those are criminal not civil matters.
Then sue them and yeah that is civil, but if they are in custody, then you know where they are don't you for getting a lawsuit ready.
Maybe your friend should have screened better, but she doesn't deserve this shit. NO ONE DOES.
