Need Advice: Landlord/tenant dispute...

I feel for you. Man, I dealt with 2 evictions in my last property. Both tenants had marginal credit (pulled credit report legally through a landlord's association), but big deposits so we thought we had it covered for the most part. Both ended up trashing the place to one extent or the other, and each owing about $6k. Took them both to court and won structured settlements each time. Quite a ride, though.
Feels so damn good to get them, but it sucks big before that.
Where I'm at, you can put stuff on the curb once the sherriff has been present for an eviction. Did that once.
Buglary is criminal, not civil. If the police are telling you that, then TO ME that means one of two things: 1) they don't want to deal with your problem and are lying to get you off their back, 2) they don't wnat to deal with your problem and, in effect, are saying YOU deal with it and that'll be fine by us. Of course, that is speculation.
Part of me says hire DIV's guys -- that is justice to me. But the rational part says take their stuff to the dump, and hire the guard and get a dog. Then you can get them on attempted burglary and criminal trespass -- those are criminal not civil matters.
Then sue them and yeah that is civil, but if they are in custody, then you know where they are don't you for getting a lawsuit ready.
Maybe your friend should have screened better, but she doesn't deserve this shit. NO ONE DOES.
Regardless, get these scum.
 
Glad I live in a landlord friendly state. Get a monitored security system with outdoor cameras to catch them red handed. Cops will then have to put them in jail for B&E, vandalism, and/or burglary. Cops say it is civil when they don't want to deal with something hard to prove and not cut and dry so this should help. Good luck.

I love the 1000 people shitting on the stuff idea. That, or just wait for them to come over, shit in your hand, and throw it at them. They will realize one crazy fucker lives there now and never come back.

Or.... go kill a couple pigs and just plaster the inside with guts and blood, they will do the shitting themselves.
 
PBR-I know it has been a long time since you posted this and still going through this. I have not read all the posts, so I may be repeating someone else. Anyhow, for those people to be doing all that and have no criminal record, no arrests-and the police pass it off as a "civil" matter, THESE PEOPLE HAVE CONNECTIONS WITH SOMEONE IN OFFICE WHO IS GETTING THEM OFF. It does not matter what evidence you can come up with. Very litteraly speaking, if this is the case, they can get by with murder, and the PD will write it off as accidental or suicide.
 
face it the back rent is history. these people live there entire lives this way. and as daddy said "you can't get blood from a turnip". you can't get something from someone who lives there life in a way to keep from having anything.
laws are different from state to state. if the proper eviction paperwork has been filed, proper time allowed, and signed by the judge the property inside the home can be removed. it is not the landlords responsability to secure it. once this is done, entering the residence would be a criminal offense. an inside suggestion, if you are going to own rental property out of state, become friends with someone in local law enforcement(LE). by simply asking a local officer if someone would be intersted in over seeing the property, either for pay or reduced rent elsewhere, i am sure someone would be interested. LE can not pull the same tricks or failed payments that others can. these things directly effect there jobs and can result in reprimand or termination.
further more LE that is on your side will use the law to thier advantage not as an excuse. passing a call off as a civil problem after the proper paperwork has been filed is just an excuse to not get involved. i would be glad to help you more if you want to email me [email protected]

This may be getting off the original subject, (I am getting more into a personal situation) however even though people become friends with law enforcement, they still have to go by the law. Obviously, your a law enforcement officer. Many people think that just because the police department has certain grudges against someone, AND YES IT DOES EXIST-SO DO NOT EVEN TRY TO TELL ME IT DON'T! but they think if law enforcement has personal grudges against someone, they are legally protected no matter what they do or say against that person. An example is an auto insurance company-Guidry- who is obviously acting according to the slander the police officers are following us and telling them. The other day, the insurance company called us and told us we had to contact all them about any discrepencies. Actually this was about the mail. We got the bill from the insurance company much later then it was mailed, and I got a letter that was postmarked well over a month. Several people in this city think they can escape federal charges from giving our mail because of the grudge by the PD. This is not the only time that insurance realized they messed up-the first time, they did not report the insurance to triple A. I had to go in and sign a different form before three, because they gave me the wrong form to sign-and that is their exlanation for not turning it in. The next day, the police officers got arrested on non relevant charges.


And pretty much this is the pattern of how the state of Louisiana works. In my situation, these government agencies have been taking some major chances based on information they recieved that is jut professional courtesy or not following the rules. That is about to be Louisiana's downfall. That is what WA and TX is doing also. Except that in TX, no one dares make a move unless it comes directly from the top. In LA, people who are siding with the police think they cannot go wrong-no matter what.

But as far as the trouble this person is posting-about these people causing trouble and law enforcement do not want to get involved-and it is to this extent, and I am understanding it correctly, there is someone in office who is backing these people. And I was in no way exaggerating about police writing off someone being killed. I can directly bring up three cases in South Louisiana . and the covering up of the evidence by the police departments was very obvious.

Since we moved back to LA, there has been significant changes and resignations in Police departments all over this area. Police resigning stops the pd from being investigated. People over in LA wants casual relationships with the people in authority-and the ones in authority allows these barriers to be crossed. That can quickly ruin a city.
 
Little late for this but here was the mistake, after one day late payment you give them 3 day pay or quit, if no pay in 3 days they get a 30 day notice. Never ever accept partial payment period, then you have a history of accepting partial payment. In 30 days they get a court date. Never accept their payment in court ever, ever just write it off and get new tennants because when they do it once they will have you in court again.

Sorry to hear the dilema, California tennant law is crap.
