I don't know if staying in the car is a smart idea, you could wind up with a 5150. Basically, you need to understand that if you are buzzed, 2 things are going to happen no matter what you do: 1) you are going to jail; and 2) you are going to lose your unrestricted right to drive (at least in CA). The only time you should take that test is if you know for a fact you're under the legal limit. (Usually about 3 drinks) O/W it's going to be positive and the DA has an open and shut case. If I was drunk (and knew it) I'd keep my mouth shut and use a one syllable word. "NO"- refuse all field sobriety and breathalyzer tests and just accept the fact you're going to get arrested and spend the night in jail (realizing of course you're license will be lost). It will be hard to make the DUI charge stick if the officer has no ammo and believe me, without slurring (bc you didn't talk), without a failed field exam, and with no test, it's harder to prove than you think. But, think about it, there's a 99% chance you're going to lose it anyway and if it's a 2nd or 3rd time, you're doing jail time, pal. I'll take the "failure to take test" and license revocation anyday.
