A good doctor should have caught that. Id raise a little stink about it, and tell him to correct it.

fgrope, listen to ItalianMuscle - jump on your doctor over this. :coffee:

It doesn't sound like he had a case. He went in requesting a cosmetic lipo procedure which the doctor performed. Ideally the doctor should have informed him that "lumps" might exist which would prevent him from achieving the cosemtic results he desired, but he still performed the services he was contracted to do.

It's like complaining to your dentist that your teeth are still crooked after paying him to bleach them. Assuming that your teeth will look perfect after one procedure doesn't make it so.

But a valid one. He contracted for lipsouction. He didn't contract for gyno correction.

I'm not justifying the doctors actions. I think he was negilgient, or at best deceptive, in not informing the patient of the likely outcome. He took his money no doubt full well knowing he wouldnt be content with the outcome.

I just don't see him having much of a case especially since it is a purely cosmetic condition which preexisted the surgery. You can't sue someone for not doing what he never promised to perform. If he comes back and says the doctor told him that the problem would be corrected with the surgery, then perhaps he has a case.

most everything in this world is debatable, i think we all agree with a good doctor there wouldnt of been such a problem so with that being said i think he is entitled to somthing. i hear what your saying bro and i try to have an unbiased opinion on things myself but i strongly believe the doctor is faulty....im glad i did stumble on this post though if i ever need or want anywork done im deff going to check references....
and to the poster good luck to you i hope it worx out!

this seems pretty shifty imo. perhaps not negligence, but certainly questionable conduct.

if youre going to remove fat for cosmetic reasons, the doctor should take various factors into account that could affect the outcome of the lipo - gyno is one of those underlying things that, imo, should ahve been picked up on, because 1) it affects the appropriatness of the reccommended lipo and 2) would affect the cosmetic outcome of the surgery. a simple ultrasound is niether inconvenient nor invasive, and therefore should have been performed by a competent doctor.

the bottom line is that it is not unreasonable for a doctor to examine a patient well enough to get a good outcome as a result of their surgery. end of story. get on the phone, chase them up, and see if you can compromise ie get the gyno corrected at a discounted price, or its lawyer time
