Btw, if you're under 21 and they can smell alcohol on you or find it in your possession (Around you), they don't have to breathlize you or test you (At least in Texas).

It was legal for the cops to search the bags and purses since they had probably cause. The probable cause was a bunch of 18 year olds with a shitload of alcohol. The cop shoving your date was bullshit, you can take recourse for that. The cop stating you were under arrest the moment they entered the room is bullshit also, cops have to exclicitly tell you when they arrest you.

on the other hand when I was underage and got busted in a hotel room with my friends with weed and lotta alcohol we all got out of it kinda easy... but I live in a city so maybe they have something more to do...

plus it was a school dance after party so they went easy on us I guess... they really tried to get someone nailed for weed which was me for a while but I havent even smoked... either way a group of like 8 of us told them that the weed was not ours and basically lotta other bullshit and after about 2 hours of their gay investigation they gave up and kicked us all out.

one guy was about to tell them that it was all his fault and it was his weed but I think it was actualyl his dates weed and thats why he was doing it

I still dont know whos it was nor care much about it, but I remember them trying to get me for it





best thing you can do it talk to the lawyer, he knows more about your state and the laws in your state than any of us so hit someone up

they had ability to search since they could see evidence of a crime when the viewed alcohol being posessed by minors. however, if they indeed said you were all arrested, and never mirandized you, this case will VERY easily be dropped. get a lawyer, tell them you were never mirandized and all will be well. that's a direct violation of your due process of law.

No need to mirandize if after saying that you were asked no furhter questions, but get a good lawyer and have everybody who witnessed your girl being shoved make statements in this state that is almosst a Death sentence for a cops career unless he can prove resisting and then he had better take her away.

lol at number 1 and 2, breaths smelt, wtf?...they don't have to ask you if you were guilty...it was balantly obivious. a roomfull of underage people +booze=minor in possession...it doesn't matter about the pbt and sobriety shit, it is illegal for a minor to possess booze. Wether you drank it really don't matter, you had possession of it. If you were to fight this in district court you would probably lose and piss the judge off. It would be your word versus the officers, who would be called in to testify...plead guilty, don't try to be a hero...
