My daughter's cell phone went off at her school today. She had it on vibrate mode. School district policy is.. they take the phone up for 5 days and I have to pay a 15$ fine to get it back. Since when does a fucking school district have the authority to levy fines???? On your own property?????????

No. I think it's fucking ridiculous. I can understand a suspension but I think it has to be illegal to require you to pay a fine to get your own property back.
 
Where's the know it alls when you need them. MTS surely you have an opinion on this matter. This can't be legal. I guess they figure who's gonna take the time to challenge them.

go in talk to the principal and im sure if you explain that you will be dealing with your daughter they will give it back without you paying,and if they try and make you pay tell them they will be hearing from your lawyer as you didnt sign anything saying that it was ok with you that they do that.

that will likely scare them into giving it back

Don't do the Aussie thing, though I am sure GD has many singlets. They cannot extort money from you for personal property. and again take the phone from your daughter or have the cell company make it so she can only call you or someone in your family for emergencies.

They have SCHOOL POLICE who coudl confiscate the phone, and arrest her. You could even be fined by the county. They run schools like prisons here. They even look like them.

Go get her phone damnit. They cannot levy a fine against you for that, it is horseshit. I know you take care of your daughter but you need to let her know what she started. Again emphasize who she is allowed to call on that phone. Then, take it to the school. Tell them to shove the $15 up their asses and tell them to call your lawyer. Mention extortion and theft and they should be happy to give your phone back.

Well I see that several of you believe that a school should be able to fine you for your child violating a policy. What's it gonna be next? Fines for coming to class late? The school districts are making a killing. Especially with the soaring fucking property tax rates around here. I wonder if anyone's pocketing that fine money.

IMO, you should demand the phone back, period. You have it for her safety. If anything should happen (God forbid) in that time, theycould be morally accountable.
$15.00? Please. Just pay the damn fine. How much do you think they actually make off this? Most kids are smart enough to turn off the phone, or leave it in their locker. The message is, for $15.00, you'll only do it once, especially if the coin is coming ouot of the kid's pocket.

The fine is just to drive home the point. The phone should be turned off in school hours she is a kid nothing can be that urgent that it can't wait tell after school. If there was a real family emergency the parents could just call the school. I agree with the fine but your pissed at the wrong people the school you should be pissed at her for not following the rules. Also if she has an allowance the fine should be coming from there.

It's not about the $15.00. It's about the kid not following rules that were set in place due to too many disruptions. If you do not follow rules, you pay the consequences, right? Well, these are her consequences. If the kid doesn't work, then make her do something extra to make up for the coin.

It's illegal to keep someone property in order to get an administrative fine paid. Unless your state gives some right of retention but in most states even a garage can't keep your car to force payment. Go there, talk to the principal and ask him for the cell phone, if he refuses, call the police and tell them the principal committed theft on your daughter.

That being said, providing a cellphone to your kid is probably the gayest thing on earth after Liberace. Why would a kid need one ? Call mommy or daddy ? Guess what, didnt have one back then and I did just fine. Next thing you know, your daughter will be begging for a brand new Mustang with 20" rims on it.

just take it back. I am pretty sure there is no actual criminal code that would allow them to do that. Tell em if they don't you'll press criminal theft charges against them and civil liberty violations as well. (check on the legality first of them doing what they did, but I am pretty sure they can't do that and rely on intimidation for compliance)

If the lawyer says its all BS and they can't charge you then sure their asses for all the time you had spent with the lawyer and your lawyer fees and that damn 15$ bill lol.

Thats not to mention you are now being billed for a service you can't use cause the damn school has it.

To me the cost of retrieving the phone does not matter in this case its the idea behind it. 2$ or 15$ it would be the same thing to me.

When you get a parking ticket for not paying the parking meter, or even towed if you keep doing it, its the same concept.

School=public
Car=your property
phone=your property
You pay a hell of a lot more to get your car back if its towed than a measly $15 to get your cell phone back.
