Should 'Napoleon Beazley' be executed in Texas, USA?

I have tried 4 capital murder trials as a prosecutor. Two of them I sought the death penalty (DAs can elect to waive the death penalty and seek only life in prison). I have stood in front of 12 jurors and ask them to sentence a man to death. Both of these men are on death row. The decision to seek the death penalty in each case was the most difficult decision I have ever made. I believe in it but don't like making the decision.

Obtaining a death sentence is not all that cut and dried. First, only certain homocides qualify. In Texas a jury must find the the killer intended to kill the victim as opposed to wanting to hurt him real bad. Even if the jury finds the fucker guilty they must answer two questions. These are (paraphrased) 1) Is it probable that the dude will commit furhther act of violence in the future so as to be a continuing threat to society, and 2) is there sufficient mitigating evidence that would warrant the defendant being sentenced to life instead of death. A jury must find beyond any reasonable that the answer to 1 is yes and then find beyond any reasonable doubt that the answer to 2 is NO. Again, this after the jury has found that the defendant intentionally killed another person. Only then is the death sentence imposed.

as for all of this shit about innocent people being executed, there is NOT ONE DOCUMENTED CASE WHERE IT HAS BEEN SHOWN THAT A INNOCENT MAN HAS BEEN EXECUTED SINCE THE MODERN DEATH PENALTY HAS BEEN EFFECT.

Ther are simply some bad mother fuckers out there that don't deserve to live. Some of them are 17.

Are Julez and RyanH the same person??? This "Kid" did not go to the candy store and steal a 25 cent piece of candy... He used a gun and shot a human being dead for his own personal gain... This is a "Capital" offense...not some little misdemeanor... "He was only 17 when he comitted the crime though" YEAH??? And the guy whom he murdered in cold blood was "only 63..with a family" A family that will never get to see him again. This "Kid" wants a "Second Chance" ???? The only we this "Kid" should get a "Second Chance" is if somehow..that the 63 year old person he killed gets a "Second Chance" A "Second Chance" for what?? To kill again??? When are we as a society going to learn that we must accept responsibility for our actions??
 
Ok May, sorry I opened my mouth. But since it was the Irish who built America and American's who made a bollox of the rest I thought I'd voice my opinion ;)
Btw in some case's I think the death sentence is justified but this is has too many questions to answer.

I think that if you are old enough to understand the consequences of your actions then you should be old enough to to have the privelages that go along with responsibility.

If you can be tried as an adult at 15 then you should be able to drive, vote, buy tobacco and booze and buy a copy of Playboy. Our country is so messed up with conservative laws that this boy could not purchase a nudie magazine when he committed this crime but then when it comes time for his trial everyone says he's an adult and should have known better. It's so damned hypocritical.
 
Does America want to be known as a country that puts teenagers to death?

I think we all know the answer.
