I got served

I'm being sued in small claims court. I was just served by some dude in a sleeveless flannel and his stripper while I was having a drink on my porch.
 
Car accident in the grocery store parking lot. Her insurance said we were both at fault. Our insurance said she was 100% at fault and then her insurance agreed. Case was closed, we got paid and she didn't, so now she's gonna try and sue.
 
How did the accident play out?
 
My wife was driving. She backed out, and while she was putting it in drive, the other woman backed into us.

Nah, I'm laying on the sofa watching Vanishing Point. I drank an entire bottle of mucinex fast max today, then i had a monster before the gym and a couple margaritas just now, so I'm feelin' like shit.

Just go to court it will get dismissed. It is her insurance company job to go after you if they feel your at fault.

Who's at fault really doesn't have much to do with who ends up owing who money in court.

The law office I worked at was a personal injury firm, and I saw the non-at-fault person end up owing money plenty of times.

Just sayin'...don't be *too* casual about it

Same shit happened with me in SF. Some little yellow bird rear ended me cause she didn't see the car infront of her apply it's breaks in response to an oncoming red light that she should have been also applying her brakes for. Was very apologetic at scene of crime, not so apologetic once insurance was contacted. I couldn't beleive she was claiming I was backing out of a parking spot infront of her....it's like, then wouldn't the damage to my car be on the side instead of straight on from the back? Was very annoying and I was very annoyed with myself for not having called the police to the scene to make a formal report.

Yeah, both insurance companies closed the case. Pretty sure the judge is gonna laugh at her.

I need to see if I can counter sue for wasting my time.

you can,,, but only for damages.. not punitive...

lost wages, cost of transportation, attorney fees..

good times..
 
Why the fuck does it matter. I just gave you sound advice. Fom what you posted in your first post. The judge will side with you if her insurance denied her claim she has no viable leg to stand on but sue her insurance company. Or just don't show up then you will lose by default. These people sound desperate so then they will file paper work for motion to show just cause.... After that the she will figure out she can motion the court for writ of replevons then carry that to the police department and ask them to help them serve it. Not sure if you know what that is. It says she can take your property that will equal that amount she is owed.

So sorry if I came across wrong. So essentially it doesn't matter who the fuck I am you handle it the way you see fit. My opinion is the take the morning or day off and just show up. So if your ever in my neck of the woods hit me up and we will smoke some of the $30 a gram hydroponic grown shit I have sitting here....

then this is how you get her back.
draw this out so you can soak up as many court dates during the work week(flex your time on the sly so you don't waste vacay time), hire a high end lawyer that costs a lot, then when the shit is finally thrown out, present her with a lawsuit demanding payment for lawyer/work/transportation...now in days a bro needs to invest a few grand for pwnage
 
Man I don't know what the fuck everyone is talking about. You have insurance. Let them handle it. That's why you pay them.

I've had this shit happen to me a couple of times. If anyone contacts you give them your insurance guys number and tell them not to call you any more.
