HELP............Possible Arrest???

Why would you say that-how can they charge me for fake gear, which is probably just fillers-if I am so lucky?

THIS IS FLAT OUT WRONG - not sure where you went to law school, but law enforcement can and frequently does record conversations in which they, officer, informant, agent, etc, are involved. It is passive recording devices in areas in which you have a reasonable expectation of privacy that they get into trouble for if they dont have a warrant. You better check up on your 4th Amendment law before giving legal advice. Just because you watch law and order doesn't mean you know everything.


As far as "If it’s fake you can still be charged and convicted as if it were the real thing" I am not sure what law that is being referred to here, since there is no general federal attempt provision here. Clearly state laws vary on this. Bringing in any meds or counterfits thereof not permitted, outside of the exceptions which dont apply here, but what you would be tried and convicted for is not the same crime as possession of schedule III controlled substance. Can you be charge with a crime for importing these, probably so, but it would be a different violation.

I have worn wires while working as a cop. I have also busted people who were selling fake drugs and they were obvious fakes. In trial (once that I had to appear) he was convicted even though the labs came back that it was fake. The crack was actually soap chips but he was convicted.

Im with you on this bro. I live right near Philly and in most cases they are prob testing to see if it XTC.

Totally wrong....

A police office can ask questions and you are free not to answer them. If you give them probable cause they will arrest you. Even then, a Mirada is only given when they are asking additional questions when you are already under arrest.

Second, courts are starting to allow statements when Miranda was NOT given after an arrest. There is also something called spontaneous utterance that is another story.

It's not a crime to open up someone elses mail unless there was intenet. Remember Culpable mental state?

I feel your pain... The PD a few towns over from me is sitting on a bottle of test and a bottle of EQ. Not to mention taking everything in my house that was labeled "vitamin supplement". I was told everything was going to be lab tested and they would get back to me. Its been two months... no contact. I don't know how long the tests take but I wouldn't be surprised if the cops that went through my house start getting bigger and stronger.
