THIS IS FLAT OUT WRONG - not sure where you went to law school, but law enforcement can and frequently does record conversations in which they, officer, informant, agent, etc, are involved. It is passive recording devices in areas in which you have a reasonable expectation of privacy that they get into trouble for if they dont have a warrant. You better check up on your 4th Amendment law before giving legal advice. Just because you watch law and order doesn't mean you know everything.
As far as "If it’s fake you can still be charged and convicted as if it were the real thing" I am not sure what law that is being referred to here, since there is no general federal attempt provision here. Clearly state laws vary on this. Bringing in any meds or counterfits thereof not permitted, outside of the exceptions which dont apply here, but what you would be tried and convicted for is not the same crime as possession of schedule III controlled substance. Can you be charge with a crime for importing these, probably so, but it would be a different violation.
