got in car accident

hey guys, i got in a very minor car accident yesterday. I rear ended this lady in front of me going like 5 m.p.h. No visible damage was done to her car and to mine. We didn't call the cops and both of us walked away unharmed. She took my info and license plate down and said that she would call me if anything was wrong with her car (she was going to get it checked out). This all happened on wednedsday.

I have a couple questions. First of all 24 hours has passed and i don't think that she filed a police report because i didn't get a call from the cops. Am i out of the woods on this issue with getting the cops involved now? Or would the holidays stop them from calling me right away?

Second question now that the cops aren't involved and she hasn't called me yesterday or today do you think i'm copletely out of the woods?

Thanks guys, i'm really nervous thinking about this all the time.
 
She does not have to file a report with the cops, though that is the wise thing to do.
However she could have contacted her insurance company who would then file a claim with your insurance company. They would then notify you. It is a lengthly (at times) process. Your ins company could send you paper work or call you and if they were to then they most likely will do it next week giving the fact that this week was a short week for many.

Hope you don't get screwed!
 
I know in MA you have 90 days to file a claim, so she doesn't have to do it for a while.

I'd expect a call from and adjuster pretty soon..
 
hey guys thanks for the info but it's now day 3 (friday) and i still didn't get a call, am i out of the woods? Or how long should i wait until i am safe?
 
You know if you had insurance you wouldn't have to worry so damn much.

Furthermore no visible damage is only about a $500.00-$800.00 repair so don't sweat it. Just get insurance you might not be so lucky next time. I carry insurance on 9 vehicles so don't cry about it.
 
She would be stooopd if she did. Just with deducitable alone she'd be out $500 and get an accident on her carfax vehicle record because of it. Which new buyers will always find out about and use that to lower the price of the car. It would be stoopid for her to do anyhthing with this.

what's up guys thanks for the info and input. I'm going to keep this running until next wednesday a.k.a. a week since the accident. I havan't got any phone calls yet and no police calls so humble pride what do you think? I fotgot to mention that it is now the end of Sunday and still nothing.

So you dont have insurance? Dont you have to have insurance to get registered? I'd swoop and squat you so fast, just to fuck you over.

Hey crabby-pants.............you don't pay a deductible if the accident wasn't your fault. All your Insurance Provider has to do is prove 51% fault in the other driver to waive your deductible.......

Also - if the accident is not your fault, no points are added to your "step points" on your insurance - so her insurance won't go up at all.....

whats up guys this is the final post unless I get a call. Pretty sure i am out of the woods. Today is offically one week from the accident.

I mean i only gave her my name, number, license plate and name of insurance company, nothing specific. Basically I can't get a call from my insurance company telling me that she called them before the lady calls me first right? I mean there is no way that she could call my insurance company before me with the information i gave her right?
 
Something similar happened to me a looong time ago. I figured I'd wind up at fault and less than $1000 liable. She said she had whiplash, traumatized her kids, and totaled the car. I went to my insurance investigator and had a witness to bring in. She had a dump truck rear end her car and filed all kinds of stuff looking for easy $$$. Turned out to be part of a major fraud/insurance scam. I walked with nothing but I have handled everything since then very different.

Did you take pictures? Witnesses? Did you make a statement to your ins?

The other party (the woman) would never call you directly
Her Insurance company would contact you. That's how it's done.
There's no way to tell if you are out of the woods, just cause' a week's past.
I used to be an ajuster, and I would get claims that originated "months" earlier.
In short, there's no way to tell until it gets to be about 90 days from said accident.
Get a copy of your policy and read it,- you'll see how long it takes in your state to file a claim.
