the truth is, my son got caught tresspassing on an abandoned property. It was an Inn - in the middle of the woods. a few years ago, the state converted it to an assisted living home for adults with mental disorders, and then they made them leave for building code violations. It's boarded up and in the middle of NOTHING.

my son and his friends wanted to check it out. The door they went in was wide open. they came out to cops with their guns drawn.
they threw the youngest, most innocent kid on the ground and kneed him in the chest, then handcuffed and arrested all of them.
These are 5 clean cut kids, doing something that most kids have done, but they got caught. we had to hire a lawyer and i'm going to court this afternoon.

Seems a bit excessive for the severity of the crime.

yup. i waited in the police station for over 2 hours with the other parents and there wasn't one phone call or police activity the entire time.

this town doesn't even have a traffic light btw.
 
Sorry your boys got caught doin something silly... but on the other hand, that is a good thing (that it was something silly, right?).

Hope it all works out for the best. :)
 
I can't believe you have to go to court for this...I thought trespassing was a simple fine most of the time...just a 'pay it and forget it' sort of thing. If they weren't there boozing or doing drugs, and didn't vandalize the place, this should be a piece of cake...no worries.

Abandoned buildings/houses are magnets for kids. I've probably wandered into 10+ of them just out of curiosities sake.

that's what our lawyer said- it's an official public eyesore (in the middle of nowhere) and even the DA said that because it was THAT building, he wasn't going to try to turn it into anything other than what it really was- our lawyer said he will be fine with trespassing. We pleaded not guilty and have to go back on the 30th for the official hearing.

You should have seen this place. holy shit. there were our 5 boys- all normal looking 16 and 17 year old boys, all wearing dress pants and dress shirts and ties.
The parents of the boys were all dressed in various forms of dress clothes- the other mother who i'm sharing an attorney with- she and I were both wearing pants suits. The other parents all looked nice. but the rest of the room... omg. they wore clothes to court that I wouldn't wear to clean my house.
One teenage girl was there because she was taken from her father and put in foster care. She was a mess, but she was also probably only 17. the father though- there to try to get custody of his kid back, was wearing black sweats, a nascar tshirt, a nascar hat, and sneakers with neon green shoe laces. He looked like a drunk (probably was) with a black eye, his face was all puffy and his hair was a mess.

there were half a dozen more families like that. it was sad.

i KNOW, We woudl explore abandoned prisions and mental instituions, usually there is stories of ghosts and crazy shit spray painted on the walls.

But both the judge and the DA seemed amenable to suggestions our attorney made on changing the offense to a trespassing.
Also, right now they can't have contact with eachother. our attorney said he would ordinarily agree with that, but these are 5 good kids with good grades and good families and he thinks it's a shame to take good kids away from other good kids, even if they did something dumb together once- since now SURELY they are all scared to do anything wrong again.
The DA agreed but the judge said he agreed too but that would have to wait for the 30th when we go back. it makes sense- realistically, he has to hear what happened before he can determine and not make quick judgements. so that's okay.

Family court probably has different rules --

sounds like you're getting 2 bites of the apple actually - you got the charge reduced to trespassing and you still get a trial to try to beat it. normally in a plea you would agree to plead guilty to the lesser crime.

If the lawyer thinks he'll be convicted, maybe he can try to arrange a traditional plea bargain now lol -- further reduce the charge in exchange for a guilty plea (saves the courts time and expense)

well, because it's juvenile court, it's a little difficult to tell what's going on- it's a lot less formal. I'm not sure if the charge has actually been changed to trespassing yet, but it will probably be plea bargained down to that (from burglary, which is dumb since my son didn't take anything or break anything to get in and it's abandoned.)

even for trespassing, they will probably get community service (which my son is already doing for nothing) and probation.
luckily, we were explained that even if they get found guilty of burglary- if anyone ever asks if they were convicted of a felony, the answer is no. as a minor, you can not be convicted.

but that won't happen. The judge must either live locally or be aware of the building because i'm guessing he used to see a lot of residence from it when it was running, and probably even still hears about it. He said he knows it's an eyesore and not secure. The police report said it was wide open too.

btw, my son's english teacher- the one who flirts with him- wrote him the nicest letter of recommendation ever. it actually made me cry when i read it.

When I was young I was a huge trouble maker. If my teachers could see me now they would be totally shocked. I was voted the most likely person to be a terrorist in the yearbook. I got lucky and never wound up in juvie.

It looks like you have a good lawyer and all of your stuff is together. Things will work out fine.

Oh, and the first time I was arrested - my mother made me walk to court (1 city over) and I had to pay the fine with a month of pay...

my point: I never did it again, because it cost ME big time.

lawyers usual fee for juvenile cases is $1500. he's charging us $800 flat rate because he really does feel it's not right, and because 2 of us came in together and he's representing us both. (we each have to pay $800).

plus court fees and fines.
