DUI is driving under the influence. The influence is not always alcohol. There is also dui 2 or more substances for people who are drunk and stoned. And if the cops suspect that you are stoned - red eyes, delayed pupil dialation, etc then they will NOT hesitate to take you to the hospital for piss and blood tests. You can refuse to take the tests but then you mandatorily give up your license for a year.
I got busted last year for driving while stoned and it was not fun. After the trial each dui charge will be consolidated into one charge of DUI Less Safe - doesn't matter if it's alcohol, weed, coke or whatever - which is a misdemeanor traffic violation. It is not a felony. However it carries some bitchin penalties. The fine will be anywhere from $600 - $1000 depending on what the judge feels like that day. Mandatory 24 hrs in jail (including time served from when they bring you in) and 40 hrs community service. These are all the easy ones. The REAL bitch is when your car insurance company gets the info. Plan on adding $100 to each month's car insurance bill. And all this is if you have a clean driving record.
