You read enough SCOTUS opinions and you see that the "originalists" do the same slithering and squirming and twisting and tweaking that the "living document" justices do.
The Constitution is vague in a lot of areas - there isn't a way to interpret it without filling in some blanks. Despite what he says on 60 Minutes and in Federalist Society luncheons, Scalia does it too.
And when you make amendments that sometimes makes parts of the original document even more vague. And that leads to all sorts of fun jurisprudence.

That's why I wish the Supreme Court always had an option "C" on every verdict. Option "C" would mean: "It's not our job to make new laws based on your inability to be specific. Get this shit right with a law or amendment and get it out of this branch of government."

They do that all the time. They say "No, this is not unconstitutional. If you want more protections put them into your state laws."
But not everything is that simple.
