Do I have a good case to sue?

My father got into a hell of an accident and the car (Q45) is a complete right-off. He suffered a concussion as well. I realize you may need more details so let me know if ya do. Anyway's the car got smashed he ended up in the hospital and the air bags didn't deploy? Can I go after the company for this, or perhaps the dealership it came from as it was a used car?

If you did want to go the sue route then yes i think they are liable for the non-deployment of the airbags. If legal strategy doesnt work the unibomber needs a replacement. IMO

But, based on products liability law, if the airbag didn't deploy b/c of a product design or manufacturing defect, you would likely have a suit.....

I was talking to my Mother today (accident was yesterday) and she had to take him to the hospital because his blood pressure was 58 over 30. He has been on medication for 35 years for HIGH blood pressure. I don't know if it is his injuries or the fact he is diabetic.

I wonder how well most 10 year old air bags are holding up?
Doesn't the gas cylindar leak eventually no matter how well designed? Like a stale battery that isn't used for a long time.

I think you could definitely have a suit. I just finished a products liability course, and if its a design defect or a manufacturing defect, your dad could recover.

First, I would check the internet to see if there have been any other complaints on Infiniti's airbags not deploying. IF there have been, get an attorney, quick.

Second, check with a mechanic to see why the airbag didn't deploy......If the mechanic tells you he doesn't know why, that it should have.....still see an attorney.

But, keep in mind, you need permanent damage to collect anything of real value. A concussion that your Dad recovers from without any long term effects, will likely get your Dad nothing, except a suit thrown out of court...

My uncle has an auto body shop and I have seen many wrecked vehicles . Air bags are very tricky and countless times they have not deployed because the impact was not in the proper area of the vehicle but to look at the car you would think that a mack truck hit them head on!I am in no way saying you have no case but and your dad did not suffer damage and injuries but I have seen way worse cars that did not have the air bag deploy! You will have to get the air bag system tested to see if it was functional and then how do you prove it was working in the forst place? Many people in florida have found out that in some cases with used cars THERE WAS OR IS NO AIR BAG IN THE VEHICLE so you drive around thinking you have one and really the cover is on the steering wheel or the dash so you WOULD NEVER KNOW UNTIL IT WAS TOO LATE?? Sounds sick but those air bags are big bucks and $$ 1,000 to 2,000 depending on the car. The body shops charge your insurance company for the part in the bill but never order the part and pocket the profit!!!!!!!! IT HAPPENS EVERY DAY AND YOU AND ME DRIVE AROUND THINKING WE ARE SAFE WITH OUR FAMILIES IN THE VANS AND SUV'S AND SEDANS.......what has this world come to?? If you buy a used car ALWAYS HAVE IT CHECKED OUT AND THEN GO TO www.carfacts.com you can enter your vin # and for a fee find out if that car you are going to buy has been in any wrecks or anything else! WELL WORTH THE $$$$$ GOOD LUCK!!

Where are you in Canada ? if Quebec I could easily help you with the Civil Code if somewhere else in Canada well I could give you an idea about what the common law has to say on it but thats all I could........
