Dangerous Dog Hearing...

Anyone ever go to one of these as the "dog owner"?

If so, is the evidence provided only from the petitioner?

Does the respondent have the opportunity state their side or provide evidence or is the only submitted evidence from the complainant on behalf of the victim? (The victim in this case another dog)

While I've never been to one of these myself I have watched enough daytime television for more than three people :rolleyes: and I am an animal lover myself ... oh, and worked for lawyers and in the insurance industry for more than a couple of years ... that being said:

We are a democracy, testimony (probably acceptable in the form of a notorized statement) as provided by a vet or animal behavioralist would almost definitely be taken into consideration, particularly in the case of a first offense.
 
I've done a lot of online research, I wrote a five page statement with evidence and photos, documentation, etc for a friend of mine and when she went to the Hearing the would not let her speak. They basically said they had enough evidence and that the dog would be deemed dangerous and the people that gave the "evidence" were not there to witness what happened. So how can a vet bill be evidence???

That's not a definition of a hearing as I understand it.

She decided to adjourn it and get a lawyer and get this - the Judge is the next door neighbor and friend of 40 years to the petitioner's momma and she's still taking the case.


I also live in a real small corupt town were the town is sued more than it's residents.
 
Both sides "should" get to present their case. The history of the dogs in question should be allowed in. Whether one has been agressive or not. The one case that I was involved in was a neighbor's dog got accused of being a dangerous dog because he nipped a child. It turned out the kid had been reaching through the fence poking at it and throwing things at it. The hearing allowed the owner to bring forward people who had contact with the dog, so they could establish a history.

The judge situation is a definite conflict of interest right there. Yeah, she needs a lawyer unfortunately if it's that much of a clique ...

A yorkshire terrier ... I imagine this animal has a long history of terrorizing the neighborhood ... OMG :rolleyes: I got bit by one once, I think it scratched my shoe leather ...

What's needed is a notorized statement from the vet attesting to the animal's personality. I'd seriously think about contacting the local animal shelter or SPCA and try to enlist their help in obtaining a personality/behavioral assesement of the dog.

I don't even think they make muzzles that small ...

What a pathetic mockery ...
 
The boyfriend that was watching the girlfriend's dog says that he was threaten by my friend's dog.

The whole situation is absurd...

A dog can't be deemed dangerous for situations between other dogs and cats only of it is a threat to a human being so now he's saying he was threatened. :rolleyes:

Really? A dog can't be deemed dangerous if it gets into a fight with another animal.

I learned last night, while watching the news, that I have to register my dog. This woman in Richmond had her pitts loose. They killed an 83 y.o. woman. She was sentenced to 5 years in prison (that's the minimum).

When I was a child, this house on my street had a chihuahua (sp?). Anyway, that little rat would run out of the yard and vicously chase the kids half way up the block.

I man feeling threatened by a Yorkshire Terrior just sounds funny....I'm used to dealing with elephant seal pups who have the jaw strength 10X a pitbull and other wild animals....so I guess its all relative to what you are used to. :)

Depends on the state - I only know about NY.

And it's only dogs and cats - oddly enough they are not covered under "domestic animals" (go figure) except for dogs that have jobs like a police dog, eye seeing dog, etc.


^^^ EDITED: to add that dogs and cat fall under "companion animal" which in relation 121 Dangerous Dog does indeed refer to dogs and cats and was introduced a few months ago.


The guy operates a business off vacant land his family owns and he does not have the appropriate licencing or insurance to conduct his business and the town related codes for the type of activity on that land in that particular area and the announcement of such activity will be part of his ... how can I say.. karma?

I mean my friend was told in no uncertain terms that if she doesn't pay a $4,000 vet bill that is allegedly "growing by the day" her dog will be put down by animal control is not only unprofessional, it's a threat, harrasment and none of it follows procedure.

Can't wait to see where this goes...

I feel really bad for her and she's very upset about the whole event and mostly because she feels like she has no rights but the good news is she just found out that her homeowners insurance is going to send a lawyer down for the next hearing on her behalf.

YAY!
