It was probably a reaction to the suture he used. Probably not a "sue-able" issue but you might want to have your doctor review the old op note to see what suture the other doctor used; certain sutures could be considered outside the standard of care for certain surgeries like yours, for example.
 
I wouldn't sue over something like that. The whole deal got messed up in the first place because of a ruputure during a normal procedure. It sure looked like hell though afterwards. My uncle is a dr and every time he'd see it he's shake his head and say "that looks like shit". lol I guess that's the medical term.

Anyhow this time I had the whole deal done in an entirely different way and it looks really good. The cut is a couple of inches long and runs on top of the tendon- left palm side of my wrist. My dr this time has had me do exactly the opposite of what the last one did and I can't believe how much better this is.
 
If you were injured and suffered damages as well as physical pain and suffering as a result of that doctor's negligence or his deviation from the standard of care, it is your OBLIGATION to sue. If it's legit, a GOOD lawyer will take it on contingency.
 
Babydoc - how much have you had to deal with lawsuits against you? Are lawsuits against docs common? I heard your insurance rates are outrageous.

I suppose if is my right but at the same time, all is well now and regardless I could have had to have surgery again as the original cyst I had in my wrist never got taken out. After the block got unwrapped from my arm it went from sticking out like a marble to being lost. I woke up from surgery last time and was told that I'd have to have it again.

This time the cyst wasn't as big as it was last time but I had grape+ sized messed of scar tissue in my wrist and that sucked. It not only looked awful but if I had weight in that hand or tipped it back it was painful. Cortizone took the pain out for a few months but as soon as the shot wore off and another MRI confirmed what was going on I scheduled surgery. So the scar tissue was most of the problem but at the same time I'd have gotten surgery anyhow...so I guess in my mind it's a toss up.

hey call a lawyer and tell him what happened and see what he says. Since everything is better now u might as well try. What if you can get like $200,000?? i'd sue for that :)
 
I have a bit of legal knowledge in this area, though not in your state. Pretty common practice to direct any complaints against a doctor to either your state medical board or the state attorney general's office. Out of your complaint (should they find it valid), the doc is investigated.

You can find out from occupational licensing, if that doc has ever been investigated or been disciplined. I recommend everyone check out your doc! Just discplined a guy who liked to cut up people's feet for experimental purposes. Really horrible.

As far as a civil suit, sure that is an option. Might want to discuss your case with the AG's office or medical board first. They should be able to point you in a good direction.

I (Maniacally knocking on wood) have never been sued. My father Once in 35 years and the plaintiff lost. Communication is the key to preventing frivolous law suits. All our mags and journals say that virtually every doctor will be sued at least once in his carreer and no matter what the reason, they say it is emotionally devastating.

And yes, in my specialty, the rates are obscene but in Arizona they're not so bad (yet) only $50,000/year

you need to become friends with some shady people, that will help you 'settle out of court', just in case any problems were to arise.

bury some of your problems out in the desert.
