Cycle funds down the shitter!

I had money set aside for my next two or three cycles and it looks like I will be using it for something esle...........an O.W.I. :worried:

I got pinched right in front of my apartment!!!! I thought I was OK. I failed the field sobriety test. the cop didn't tell me what I blew on the street but when I got down to the police station I only blew a 0.079! (legal limit in my state is 0.08). I thought I was in the clear but the cop said I had to blow two more times. I ended up @ a 0.10, got the ticket and sat in jail the rest of the night. This is my first offense and the fine was $800 and if I get convicted, 6 months without my license.

I'm going to try and contest it but I don't think I'll have much luck. I feel like shit cause of this and it couldn't have happened at a worse time for me. Not making excuses or blaming the cops, but this does suck...yes indeed.
 
OUCH!! I feel your pain there man. About 15 years ago in my 20's i had a nice little string of 4 in a row. 1 each year :)

Cheer up though my last one cost me $60k but thank god it was before the 3 strike laws. Just look the judge square and tell him you don't agree but you accept his ruling. Bring up the breath-alizer readings and talk to him straight up, but dont' appear cocky. You'll save the most money with the least punishment that way. I did my first two solo but the last couple i had to bring in the pro's

Just a speed bump for you though, just learn from it and keep your head up....it happens to more people than you think

I risked it many times during college. I tell you I barely even go out and drink anymore.

Yeah, that's the thing. I barely go out. Maybe once every couple of months. I don't even keep beer or booze in the house. Just a few drinks after dinner with friends. 0.08 doesn't leave you much room.
 
If you get anymore you'll find out quick how much they add up. The last one i had $10k for a lawyer cause i got stuck in jail for 9 months awaiting a court date. Plus i had like $15k in property damage restitution. Rest all fines so learn from that.

What can i say? Sometimes it seems like a good idea to go out and get drunk and then run into your buddy's house at 40MPH with your truck.

It's kinda funny now. Well now that i don't drink it is LOL

Bro, I'd roll the bones and contest it, even with a PD you got a fighting chance. Depending on where you are you can get a private atty that could do it for you for a flat fee. You got some doubt between the time he picked you and the subsequent times at the station. If the cop didn't tell you he's probably bluffing.
 
i got one at 19 , learned my fuckin lesson.. and about $2000 gone, along with 180 days loss lisence... if it was during school, that would have been fine, but it started at the beginnign of summer! that suckked!
 
I have 2 and the lawyer I had on my last is very good, costs a lot too. When the breathalizer is that low he will thake it to trial and argue a decrepency in the calabration of the machine. He said he usually wins them. My breathalizer was way too high to even think about that. Ive done some dumb shit before while driving drunk, but not like driving into a house, that is insane :D

what state are you in? if its like AZ grab a lawyer, plea that thing down to something else. i know my total cost was around 12k or so. if you want to talk about it or want some information shoot me a pm, trust me, once i tell you what i had and then walked with you will understand. yes, you made am mistake, i took mine to heart to make sure it never happened again

Yeah Div Bro,
Nobody is more dissapointed than me. Full time single Dad, with alot of bills to pay. Like I said, I'm not much on drinking. I like a few beers once in a while, but my party days stopped when my son was born 8 years ago.

I think I have a good chance of getting it reduced but if not, my boy and I are going to be doing some serious Mountain Biking(urban style) all Summer!
 
The cost of a good attorney will far outweigh the negative issues associated with a DWI conviction. Just my .02.

I am wodering how much room does .08 give you. I heard 4 drinks in an hour then 1 an hour following the 1st hour for a 180lb man. Is that right, or is it way off?

Any chemists out there can answer this one?

yeah mine was about the same price.

After all the bullshit you go through in the legal system you wont ever drink and drive again - or at least thats my experience.
 
I had one when I was 19. I was drunk as shit but I didn't blow and it all got dropped in court down to an improper lane usage. But I got a automatic 6 month suspension for not blowing. Then when I was 21 I got another about a week after my 21st. I didn't blow b/c of what happened the 1st time...figured I'd beat it again in court. WRONG! In Illinois your second refusal to blow is an automatic 3 year suspension, regardless of whether or not you get a conviction. I just got my license back a little more than a year ago and I'm 25 yrs. old!
 
not to kill the party, but drinkin and driving is a big NO NO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Alcohol isn't worth all the bullshit associated with it......I don't drink at all.

A word from the wise, don't ever blow or do field tests...If you don't do anything they don't have the proof. You may lose your license for six months, but it beats a DWI. Also, don't be a dick to the cop, because alot of the time if your cool, they just might let you call a friend to come pick you up. A DWI charge takes tons of paper work that alot of cops don't like to do. My wife's been working for any attorey for fifteen years, and thats what he told us to do...Good luck my friend..

How about, don't put yourself in that situation in the first place?

Then you won't be at the mercy of the cops as to whether they want to charge you or not......

Why do people do these stupid things?
I know a commercial truck driver who tested positive for cocaine.
He had to undergo 6 weeks of rehab.
A week after he started again, he was busted again on random test for a norcotic.
If his doctor had not done him a big favor by giving him a note, his licence would have been gone. And that is his livelihood.
A kid on another board said he has been drinking and driving since age 15.
He says at 17, he took 21 shorts of whiskey over 1 1/2 hour, and then drove!!!!
I cannot understand why people so casually put their lives and other people's live at risk.
And then they do it again, and again, and again. ???????????????????????????

The negatives outweight the positives and that's not even factoring in the legal aspects of DUI/DWI.

Alcohol will set you back.....it robs your body, puts strain on your liver.....basically all the training you did that whole week is down the drain because of one weekend of partying. To me that's not really worth it....

Not to mention you tend to make bad decisions when you are drunk.......(ie fucking that broad who doubles you in weight, fighting, saying things you will regret to people and you look sloppy). All things being equal, the dude who is sober will get the chick over the sloppy, loud, obnoxious drunk guy.

I used to drink a lot. Got a DWI at 17 and at 19. The first one I had my samples independantly tested... good thing too. One came back .11 the other .31... someone tampered with them. It got dismissed on the way to Supreme Court in my state.
The second was a .08... I worked out a deal with probation etc.
I don't drink much anymore. Two drinks tops in a day if I have to drive.
Rick Collins has some nice protocol on how to deal with getting pulled over on his site. Check it out for future use!

Hey Bros,

Thanks to all offered both positive and negative feedback. Getting busted for an OWI is nothing to brag about. But hey, this is real life and sometimes you hit a few bumps. I'll take my lumps for this. Live and learn.

I'd still like to hear more opinions/advice. Keep it coming.
 
You'll do fine GS. Right now you'll have allot of anticipation b4 you get a date for your hearing. Just remember if they take your license for a bit to go and get a work permit right off the bat. It will at least get you back and forth. I hope they still do that. Been awhile for me
