Anyone know anything about a restraining order?

What do you have to do to get one? I'm seeing this girl who'se husband (they're in the middle of a divorce) is an alchoholic fucktard and keeps showing up at her place at like 11pm and banging on the door and waking her kid up.. Do you go to the courts, or the police, or what... Anyone have any personal info on this?

You can file a petition with the court. call the local clerk of courts office for details.

Okay... I work with a shitload of attorneys... here is what one sent to me... specific to my state/area though... I am sure..

"You may apply for an order of protection. Where does she live? If in Missouri then you can apply in the Court of the County where you live. Her repetitive conduct amounts to stalking under the law. If you shared a residence with her you can also seek the order protecting you from emotional abuse. Have you kept a log or something? Witnesses?"

"Since you didn't share a residence then you need to make the complaint based upon "stalking". Stalking is defined as when an adult purposely and repeatedly harasses another. Harasses means engaging in a course of conduct directed at an adult which serves no legitimate purpose that would cause a reasonable adult to suffer substantial emotional distress. If you have undergone this emotional distress due to this repeated behavior then you can apply for a restraining order. You need to emphasize the consistency of her conduct and that it serves no purpose."



So... basically keep a detailed log... if you haven't start writing down what happend to the best of your knowledge with the approximate dates/times... write witnesses names down for each incident... and call the police to make a report...

If they don't do somehting for you.. you'll have to file for the order on your own... Like the attorney said... MAKE SURE to emphasize that these incidents server no legitimate purpose other than to cause distress...
he will obviously claim he needs to see the kid, etc.. you are going to have to convince the court that isn't his intent....

I came so fucking close to doing this it isn't funny. I still log all incidents with Psycho Ali in case she gets nuts again... 'cause I won't put up with one more confrontation from that bitch...

I know here in NJ she can just go to the court and they will immediately issue at least a temporary one if she claims threats of physical harm. The I believe there is a hearing on the matter where he gets to give his side of the story.

If there is any evidence (witnesses, such as neighbors, voice messages etc,) I'm sure you both know enough to save them

dude the very first thing she should do is call the police and at least make a report of his actions even if no charges are filed against him (so his actions can be on record, very useful in court of law). You need a paper trail. I suppose going through The States Atty is the procedure for securing a restraining order. But IM not sure and I didnt read everyone else's posts.
