Yes, I think it is just an advertising scam. I have been doing research since I started this thread and have found that supplements don't get taken off the market easily. Ephedrine (Ephedra) for instance has supposedly caused a number of deaths and it's still available. But the FDA requires a warning on the label, and I believe they made it illegal for it to be sold in potencies above 25 mg. If Ephedra is still around and it can cause heart attacks, I really doubt andro is going to be outlawed. Also, if andro were outlawed then it seems they'd have to outlaw a whole slew of other things too, like Gensing, Tribulus, Maca, progesterone, and soy extracts - and I guess even soy beans. These all have hormone boosting effects.
Now, whether they decide it's an "anobolic steroid" may be another matter. Webster's Dictionary defines anabolic steroid as a "synthetic" steroid. I was under the impression that Andro is all natural, extracted from pine trees, so I don't see how they could call it an anabolic steroid.
