Don't know quite what to think...anyone? I know there was a big thread on this...I'm anti-death penalty, and basically kind of stunned. Damn.
 
Does anyone really think she'll get the death penalty?? I can't imagine they'll give it to her, but it is Texas...

How could anyone think she's not insane? I mean, I know, I know "knew right from wrong", but she is SUCH a nutjob...damn damn damn.

btw, capt. insano, I love Bret Easton Ellis, but hate the word cunt. Go figure.

she was psychotic and had an artifical system of right and wrong. It wasn't like she did it out of spite.

id be suprised if she didnt get life. i do think she is FAR too dangerous to be allowed to live in the community...i dont think you can ever fully cure someone like that. maybe you can i dont know.....but i dont think they will kill her

If they don't, then the inmates will. Inmates do not take to well to children being murdered.

its a risk.....assuming she gets put in general population, and not a mental hospital/prison....having said that she'sn probably at risk in both....first chance someone gets they will probably knife her

question: She was not found insane, but convicted of capital (capitol?) murder in texas. Does this mean that she does NOT have the option of a "mental prison", or low security prison for the criminally insane, blah blah blah...you know what I mean. Doesn't she have to go to a standard federal women's prison?:confused: :confused:

didnt know that. we're talking about the nutjob that drowned her kids right?.....i hope she wasnt denied mentl treatment due to the severity of the crime....

but if she was convicted in texas of 1st degree murder....i dont think she;d get the mental ward option. in fact i think the death penalty would be a very real option

I just watched the verdict live, and the charge was read as "capital murder"...that's first degree murder right? Hope this isn't asinine...:rolleyes:
 
She has not gone through penalty phase yet- she will receive either life in prison or death (the later will take 8-11 years)

no idea....but as the murder charge didnt have the word 'insane' in it, and capital inferring no.1 i guess so :)

She may have been able to pull it off in California, but in Texas we don't let shit like that fly. She will most likely get the death penalty.


I think the three hour deliberation time says a ton about how the jurors felt on this Case.

LOL--wouldn't they need strap ons to do that in a women's prison? I don't think she would go to a mental facility, since they found her competent to stand trial. I'm not sure though. I hope she gets life in prison without the possibility of parole. What she did was really horrific, and I don't buy the postpartum psychosis crap for a second. I think her husband is a nut as well though.
 
Yeah, I do agree that her husband was a true nut. Anybody else think this? He was sooo supportive right after it all happened, I remember a press conference with him around that time, and he was really calm and sympathetic towards her. What's going on there?

My guess, honestly, is his response was part shock and part knowledge. He knew she was having psychotic episodes. He knew she exhibited psychotic behavior. Couple a person living in that kind of environement ("caretaker syndrome") with the shock of having your five children brutally murdered... and his press conference behavior isn't overly surprising.

I wasn't overly surprised by the verdict. I followed the case closely and it has been apparent for a while that she did not remotely meet the criteria for a not guilty be reason of insanity verdict. Don't get me wrong... she is obviously a whack job... but in her case it is not a supportable defense.

She can be sent to a mental institution, but it is unlikely. We have plenty of mentally ill people in prison... and the state's primary concern with her is going to be incarceration... not treatment. She can get all the psych meds and three squares she needs in a 5x7 foot cell.
 
nice post Mr. George...Have you read anything or seen anything about this husband? For some reason, I think his behavior is really intriguing...what was his role in the trial? I know that he said, at least in the same press conference I mentioned, that he did believe she was insane...hmmmm...

He believed, and correctly so, that she was mentally ill... and she was definitely getting the revolving door of psychiatric care prior to her murdering her children.

The mistake he, and most others, made in assessing her situation was the assumption that mentally ill/psychotic behavior was a standard for an insanity defense. It is not.

He played a minor role in the trial, a summary of his pretrial depositions is simply to support the defense that she exhibited mentally ill behavior prior to her murdering her children.

I think a big part of why his behavior is so intriguing is to see his "nice guy" support of his wfe in light of the horrific nature and brutal cruelity of her crime. I think guilt must play very heavily on what he is going through and went through. Clearly he knew his wife was a whack job and clearly he did not take appropriate actions to protect his children. He is supposed to be the "sane" one of the two... and it is very easy to judge someone's actions in hindsight... but I think a big part of what we saw playing out was his own guilt that he did not take the actions necessary to keep his children safe. I would not want to live the rest of my life in his shoes.

SofaGeorge, I wish I would have followed the trial more closely, thanks for the great posts. I still wonder how much this husband knew about what would happen...I mean, how could he leave one day, having no idea that this sort of thing was on her mind? I suppose my idea of marriage is not the same as this dude's...clearly...
 
she deserves death plain and simple. What a sick cunt. Husband is a dumb shit. He should of realized something was wrong and if anything at this point wanted her killed. The bitch that got life for driving her kids into a lake and blaming it on a black guys husband wanted her fried.

that not guilty by insanity is bullshit. john douglas, the original fbi profiler, spoke at my college once and said that despite all the claims that serial killers are insane because of the crazy, sadistic shit they do to people, NOT ONE attempted to attack someone in an unopprutune situation.


If you try to kill someone in the middle of a mall on a saturday with police officers and hundreds of witnesses around, then you may not understand right from wrong. But if you wait until you have an opprutunity to attack a victim away from people or law enforcement, then you know what you are doing is wrong.

I've never heard anyone provide an argument against that.

actually it was 3 hours 40 minutes... they were probabley waiting on one more round of donuts before going back into court.

And as for the past-partum syndrome - the effects typically last a few months, not years. Combining her and her husband's religious fervor with the cessation of her medication for treating mental illness - she pulled the proverbial safety off her behavior herself.

No child deserves the abuse/killing from a parent.

He's probably gonna say that she needs medical treatment and that it is wrong for her to recieve the death penalty.

This isn't really a valid point when it comes to justice... but wouldn't it be considerable cheaper to execute her in 10-12 years (or whatever amount of time it may take) then to keep her alive and healthy for the next 40 years.

I'm the wrong one to ask. I've worked in the joint. I'm in favor of the death penalty for armed robbery, child molestation, any repeat felonies that involve violence, kidnapping... etc...

The average violent "prisoner" in the US is not a human being. They are some kind of genetic throw backs or misfits. There is NO value in letting them roam the streets.

Either give them their own island, cut their balls of at 12 so they don't breed, or kill them.

But don't tell me they are people like us. They aren't.

its actually cheapr to imprison them for life than it is to kill em

when your sentrnced to death their is a lot of lega work to make sure you guilty etc, much $$ spent
 
ladymacbeth, the reason you toast her is to tell people that if you kill people (especailly kids) you will pay the price even if you try to use some BS excuse as postpardem depression. I understand that it may be tough on some women, but that is no excuse for killing your kids one by one in a brutal fashion. If she had just exploded and punched 1 kid to death i would have more sympathy, but this was way to detailed of a killing. I doubt there will be any more women in texas killing their kids. "Deterrence" in a word.

By the way, would any of this be news if she had killed somoene elses kids in this manner? doubt it. So what these yates advocates are saying is that if you kill someone elses kids its bad, but killing your own kids is fine.

I've always found this a pervasive and insane logic that somehow it si more "acceptable" for women to kill their own children.

I remember one very famous Colorado murder case. A woman just murdered her second child. She had killed her other kid like 10 years before. Another woman that I knew was arguing that this woman should only get a couple years (like she did the first time) because she really didn't present a danger to society... after all... she only murdered her OWN children.
