Cases not always cut an dried

Not all of these cases are as cut and dried as you think. The turd in Mass. should have got life w/o parole. There are varying degrees of child molestation. What is techically Seaxual Assault of a child in many states, some of you may consider ok. For example, if a seventeen yearold guy has consentual sex with a 13 yearold prostitute, in Texas he faces life in prison?? This is a case where, if it gets indicted, the defendant should get some form of probation. I am preparing to try a case where a 41 year old man anally assaulted his 5 year old step-daughter. I have offered him 50 years in prison if he pleads guilty just so I won't have to put the lil girl on the stand to testify. Sure he deserves life (or even the death penalty) but that child deserves a break too!!! There are a lot of factors a prosecutor (and even those morons called judges) have to consider when assessing a sentence of recomending a plea. I hate to ever second guess without ALL of the facts

Also, a new trend is to keep child molesters in prison as "sexual pedators" even after they have served their complete sentence. They are held to undergo counseling until they are cured. Since these fucks can never be cured they may stay for ever. One of the "M" states (Minnosota?) in the frozen wastelands noth of the Texas panhandle came up with this great idea. It has actually been held as constitutional . A lot of State's are adopting this plan.

Laserdude: I don't think I'm qualified to speak on behalf of the "gay bro's" to which you referred. There is a difference between a child molester and a homosexual. By the way, the vast majority of child molestations are men with little girls. I don't think that any "heterosexual bro's" should have to defend their sexuality when a child molestation occurs

As for the apparent lack of rehabilitation of child molesters, I thought Baylor University School of Medicine (Houston, TX) had a program with an 80%+ success rate. It seems, therefore, that some pedophiles can be rehabilitated.

A few years ago, I remember that a repeat child molester asked to be chemically castrated, so that he could end his urge. I don't know whether this would really work, and I'm not sure if this constitutes cruel and unusual punishment under the Constitution, but it is another possibility--in lieu of the death penalty or life without parole.

Vesectomy condition

I once made it a condition of a defendant's probation to get a vesectomy. It was a drug case and didn't have shit to do with his probation but he was 26, had 9 kids by seven different women and wasn't supporting any of them. the condition was probably void but the dumb ass did it anyway.

nycdefender, I did not mean for you to misunderstand what I wrote as I know your not gay.

This was addresed to the gay community, and I did not want them to feel like I was pointing the finger at them. I just the opinion of the gay community. I am sure they are mortified as I am.

I have a older brother who is gay and has aids, so I am a little sensitive to that, with him being my brother. I do care about him and his health. Believe me this has been a worry for a long time. My brother would feel the same as I do on this subject matter.

I remember when the guy asked to be castrated, though I think he was denied it...Kinda strange but I guess it's good the tax payers didn't pay for it lol....Personally I dont feel people who do things like this deserve to live, but on the other hand if someone is mentally ill, has no idea they are doing such things I would pray that one day there is a 100% way of changing them for the better. Untill them this will be a struggle for society to protect the children and to keep those that are ill away from them

Hypothetically, who would be raping this childmolester while he is in prison? Would the prisoner(s) raping him not be on the same scale as him? And if we as a society allow this to happen, would we not allow the childmolester to become a victim - he is a perpetrator and doesn't deserve to be a victim, IMO. Rape is a vile and heinous crime - but I don't believe that even rapists deserve it as punishment for their crimes. Also - we should not allow anybody to commit this crime, regardless against whom and under what circumstances.
