In the states, could you really use a gun in a situation like that?

You can use deadly force if you are met with deadly force.

Also, you can shoot a person if they force their way in to your home. (In most states, it's the "make my day" law)

In this case had the poor chap who was getting worked had pulled a gun and shot one of the guys, he probably would have been charged with murder, attempted murder, or at the minimum assault with a deadly weapon. (Again, in the USA)
