3-5 years in guantanomo bay and I would be asking for execution aswell... anyway, i keep on reading news on how almost on monthly basis they are releasing accused murderers who were falsely incarcerated for past 20-30 years based on dna evidence. It seems like sometimes they just want to throw some people in jail or hang them just to make a point. I'm against the insanity defense and pro death penalty, but if you give it to the wrong person I think it's just really fucked up. And also, depending on how much money you have in your bank and which lawyer you can afford, there's no way of getting equal representation in court.

Yes i knew that one would come into play. You know what though, I've lived in 3 very different countries and from just observation, it seems like the people that went to jail were the ones who seriously deserved it. I hate hippies and druggies but I have friend who has an MBA from one of the top schools and was charged back in college for possession of weed. Can't get a job. Hasnt smoked weed in years. For the country, they put him into counterproductive situation. In england you would get some community service for that and I think that's a fair punishment, u fucked up you pay back by working it off. Not by writing off your life. Taxpayers are paying for for people who are in jail for their existence, they are not contributing in any way, then they get out and they either commit another crime or can't get a job. Lot of laws out there are there just to clog up the system and make it bloated.

The major flaw in US justice system are the draconian drug laws in major need of overhaul. But this is already happening in california and other states, and will continue until at least marijuana is totally decriminalized on a federal level, which will filter down to the states in entirety. As far as the rest of the CJ system, once again, its not perfect but works.

During the most corrupted times, their legal system resembled american. but still the jail was usually reserved for either corrupted politicians or people who seriously deserved to be there. I understand US is a very competitive country, but when it comes to law, you cant just make it another competition. You're dealing with peoples lifes that once and for all puts a stamp on their existence.
 
I guess what im trying to get to is... there's better ways to punish people then just deeming them useless for rest of their lifes or throwing them in jail.

Our CJ system is based on meting out justice and giving punishment, not "trying to insert them into productive situations". If youve got a better way to punish someone who commits serious crimes like murder, rape, or armed robbery, Im all ears.

the victims of racism, poverty, sexisim, homophobia, etc.

If you dont want to get acquanted with the US CJ system, dont fuck up. Everytime I got involved with law enforcement it was my fault, and I dont whine like a little bitch about someone keeping me down or any other bullshit. That includes the ticket I just got on my birfday. Im going to court over it in a completely legal manner, im not taking to the streets with a picket sign or calling the ACLU over some horseshit.
 
Obama really dropped the ball on this one (yes we can!). First off, cuz of the CIA torture tactics - all the confessions will be thrown out. In us justice - you can't have confessions from waterboarding.

Also a lot of the evidence is gonna be challenged and major doubts cast (think oj's glove was big, imagine evidence from thosuands of miles away obtained by 18 y/o's and paid informanets who may be paid for their information). Not to mention al the ACLU, Saudi consulate lawyers and ME citizens following the trial.

My prediction: The top guy'll get the death penalty - make America happy. 2-3 will get 10-20 years, 1 guy will be hung jury and returned back. All will be well in the world.

Well like I said im pro death penalty, for people who deserve it. If there is hard evidence against the 9/11 people, throw them in the furnace,. There's little hope for rapists and serious criminals but theres small crimes that follow people forever.

I'm not talking about myself either, i was stupid and drunk theres no one to blame but me. Speaking of which whatever they wrote me up for will soon be dropped because I was able to afford a competent attorney. So yes I to some minor extent I have experienced the legal system myself. I am paying for it in cash prettty much, my lawyer who will make more cash will also pay more taxes so the system is well oiled machine.

That's not what Im talking about though. In college, I took a business law class taught by a prosecutor. He said, "always be nice to a cop who gives you the ticket or arrests you" the reason being is that whatever he writes in the report is the deciding factor if the prosecutors will drop the charges or pursue them. ONE word can make a difference. With that said, the prosecutor who taught the class actually went to same school as me but for JD not BA. He was arrested by a cop during a football game who said he smelled of alcohol and they had to take him back to strip search him. He sued the school police and won because on that night he wasn't even drinking. He actually made the headlines I guess.

Now those are serious crimes, and if convicted without any doubts I think they should be put away for a long time. But then again, you got cases like kobe bryants where it's just all about money. There was a show on hbo on how groupies manipulate their way into athletes bank accounts pretty much. I've only heard of one case where the bitch got countersued for false allegations.
