One defense, that is suggestive to me in these cases is misuse. According to the original article, the coroner's report states that Bechler had"substantial amounts" of ephedra in his system. I would like to have that quantified and argue that he exceeded the recommended dosage.

people want to make substance A illegal becuase of someone dying from it's use. I would dare say that poor eating habits kill more people in this country than anything else. Are they going to make it a crime to eat like shit.
