Sperm donor and delivery ?

Guys,

I have a guy friend who was asked by a female (ex-GF) to impregnate her. She claims to just want him to knock her up and walk away.

He would not ever think about having anymore kids, or ever raising one with her… He would only consider doing this as a favor.

Is there a way he can cover his ass legally so he won’t be responsible for child support later???

I would go to a sperm bank and look at the documents they make the woman sign before she's inserted with someone's stuff. He should have a lawyer prepare something for her to sign before he does anything.

Legally, I don't think there is a way out of it, no......

Think I remember reading a story about this somewhere before.....

There was a documentary about it one day where the lady went back years and collected child support.

I'd say for him not to do it, There are a ton of sperm banks.. she can go thru them. Just a scratchy situation with them being friends and all...
 
TELL HIM NOT TO DO IT.

Under State laws, he will not be considered the father. But if the woman further wants to pursue the case she can go to Federal Court and win. I read and heard that even if a person is donating his sperm, Federal Law still sees him as the father.

I checked the confidentiallity documents of sperm banks and they only mention state laws but talk nothing about federal laws. I thought this was an easy way to make money since they pay $70 for each donation. But then I dont want to be liable for anything 5-10 years down the line.

From what I know from family law he'll be responsible regardless of any legal document. The right to support is the child's and not the mother's. Therefore, she can't assign away rights to support because she has no standing.

Bottom line, does he trust her or the child to not come after him for support in the future? Hypothetically, if if she never tried to collect he could have an eighteen year old child coming after him to collect back support with interest. Considering one can get a felony and go to prison in most states for non-payment, not a risk I would take.
 
BRR-it all depends on where he is living and what the laws there are...
I have heard of women doing this to men after years of no contact and such.
But i have also heard of people that have given up parental rights to the child and including that is custody,child support, etc....
He can call his local family court and ask a few legal ? or even call a family lawyer..
Also i think they may be able to type up a paper stating he will have nothing to do with the child and then both him and her can go and sign it with a notary pulic and have it stamped that way if she ever goes for support he has proof of the agreement.

i hope he understands the mental responsibliteis knowing that some kid at 18 will go looking for him.
 
Generally, parental rights and the resultant child support is severed under two conditions.
1. Children's services consider you a danger to the child and they prove it.

2. Adoption, you will be held responsible for all support until the adoption is final.

An anonymous donor may be protected by doctor patient confidentiality but in this case it doesn't apply. You have to know who to sue for child support. Also, if she is married at conception or the husband/father voluntarily accept responsibility, in most states the husband is presumed the father by law.

I was going to post a link to the Texa statute as an example but it's just legalese most wouldn't understand, not because ef peeps aren't smart enough,just that it's legalese and practically indecipherable to anyone who hasn't been exposed previously.

The only reason anonymous donors are protected is the doctor patient privelage and that doesn't mean a judge won't judge society's interest in having supported children greater than the doctor patient privelage to non-disclosure; It's the non-disclosure that protects you.
