Question for the legally educated

When ordering domestic we mostly do mailorder from outside states. But do different issues arise when using a source from within your on state? Actually same city?
What I'm refering to is every once in awhile a domestic gets busted and his computer gets confiscated. Sources are sometimes sloppy and leave addresses on their computers. Now when the customers are out of the state interstate jurisdiction can be problematic, and may be too much trouble to be bothered with. But if the customer is within easy reach would you agree you're more likely to get a knock on the door?

And is evidence on a sources computer - buy/sell info enough to get a search warrent to search the buyers home?
 
Warrants are issued based upon probable cause

there would have to be more substancial evidence (ie. see the actual transaction take place)

however, they can basically search your house if they want(they will find a way).

ie. Fruit of the Poisionus Tree Doctrine would fall into this category
(evidence cannot be used if the reason for entering was invalid) (exclusionary Rule to the 4th Amendment)

but also exceptions to the Exclusionary Rule that allow evidence to be valid even though a search is invalid

1.independent source
2.Inevitable Discovery Doctrine
3.Good Faith Exception

It would be hard for an officer to prove that a transaction actually took place, goods were exchanged, and that it was legitamate and not for "entertainment purposes" as we here on the board use.

to answer your question, they could get a warrant, it would be hard to prove, but most likely if they were to contact u in the least, they would prolly ask u to help thier case againt the dealer rather a buyer (customer)

I'd say stay away for from same state orders, it's very easy for a rookie cop to get the state police involved, where as with different state orders require the feds involvement, and I think they have bigger fish to fry, but still could happen. I have also heard that some sources will not deal with people that live in the same state just for that reason.

If they want to make a bust, it doesn't matter if it's the other side of the country. It's just a matter of a phone call to alert the local athorities. If they don't warrent it big enough for a bust , it won't matter if it's 2 blocks away.

Bottom line: Don't worry. If nothing happens, it's just wasted stress. And if something happens, you're not going to do any talking anyway. That's your lawyers job.

I think you're closest to the truth here. Not necessarily a rookie cop either. It's just so much easier for them to give me grief when I'm 2 miles away as apposed to 200 and in the same state. Same cops that busted the dealer can come and try and play some games with me.

Don't get me wrong, I'm not worried about them getting me to implicate myself. I'm worried about the search warrent. My place gets searched I'll be on the TV news..
