Pushing the dress code at work

How do you handle that as a manager?

I mean you can't fire someone because they'll immediately sue. what do you do?
 
She's got pants on... Hen I worked at lowes we could wear khakis or jeans... They never said they had to be loose or baggy.

They can hire whoever they want. Every company I have worked for has a dress code policy. If you don't/can't follow it, you don't work there.

Besides, doesn't look like this woman can afford any atty.

The attorney would work for a piece of the settlement. She'd have no out-of-pocket outlay at all.

What lets her win is how difficult it would be to ban that via dress code. Falling back on subjective terms like "appropriate" is a breeding ground for lawsuits. The only way I could think around it would be to explicitly say all leggings and tights must be accompanied by pants or a skirt that meet certain criteria.

That would be an ugly situation to address from an employer's perspective.
 
At any employer I have worked for, they don't allow leggings or spandex at all, stated specifically as such in the policy. So, she'd be screwed. The burden would be on her to prove she was in compliance with the dress code. But it doesnt look like she's working in an office so who knows what their policy states.
