odd question but need ur help!

long story short.... wasnt yelling, rant raving or raging.... kicked a garbage can.( not all that hard either) nothing in it, garbage can did not break... cops were a few yards away. saw me. gave me disorderly conduct fine.... i was very cooperative with the cops and the bastards still give me this...

what do you guys think i should plead? or do


was on tren test a bombs and kept my cool with the cops and i still get this shit

First of all, find out how "disorderly conduct" is defined by the statutes of your community/state. Otherwise I can't tell you whether to plea guilty or not. Where was the garbage can? was it within your property, in a parking lot or what?!!!!

it was not on my property. but either way, there was no damage done to any property

Well, in my limited experience, disorderly conduct is a catch-all category that cops use if that don't have something specific to charge you with & want to get you for something.

"In the criminal law of the United States of America, disorderly conduct is a name given to a rather ill-defined crime. This offence is committed, in essence, whenever a person engages in activities that annoy police officers or similar officials, or come to their attention as a result of citizen complaints"

It is probably best to find out how disorderly conduct is defined in your state/area & go from there. However, the fact of the matter is that you have already been charged with it so it's probably better to focus on the possible penalties for it. No matter what, I would definitely get some professional legal help with it unless you want to just accept a plea arrangement (if offered) by the state/county/etc attorney.

this is a college related incident so almost all of my friends. if they are polite, can talk themselves from an underage drinking or something of that nature... to something minor... the city just wants any money they can get... i imgaine ill be able to plea bargain it down... if the lawyer fee is going to cost more than a lower fine will be, then there is no point to even bother with the lawyer...

Well, if it's a college town, then you're right, they're probably just trying to generate some revenue by fining you...if you can get away with a misdemeanor & fine it's probably a good thing.

i just dont know how to argue it... i mean oviously i was in the wrong for kickin it... but like come on is kickin a garbage can, when no other damage was done nor was anyone else disturbed really worth a 300$ fine

Sounds like a pretty stupid ticket but I've found more often than not it's easier to just pay the fine and move on. With all the time and effort it takes to dispute anything I'm losing money taking the time to argue it.
