new law???

congress just passed than new law , they can now check through emails and cell phones records, what does this mean for us??????
 
i was wondering the exact same thing. I have no problemwith them using it for terrorism but it will most likely be abused and used for other reasons..............any OFFICERS of the law or LAWYERS have any opinions.............it makes me a little worried, however, i am really not that interesting of a person to even be bothered with
 
The new changes in the laws are supposed to only be for investigations on terrorist activities. I think I've mentioned this before... they don't have free reign to just tap people randomly... they still need the probable cause to get the warrant... they just don't need to have the warrant before they can start tapping. Also, they can now tap "people" rather than what the law said before to tap the actual "phone". This will help counteract terrorists who get a new phone every week... the feds can just keep tapping the new phones as the bad guys get them.

Now, whether the feds will abuse this power... I don't know. I do know that if they do use this law to bust guys who happen to have AS... they'd better have some evidence of terrorist activity or thier search/seizure will be unconstitutional.

No Way. Talking about AS, posting cycle information, or even saying that you have it up here isn't enough to get a warrant. Now, saying that you are a source, explaining in detail where you hide your gear... that might be a little red flag for them to observe you a little more closely...

Also, none of the information posted can be used against you in the court of law... can you say... HEAR-SAY? :)

Tell that to the cop who freakin.....

Pulled me over last week. It was a sunday after noon and I picked up a prescription for one of my family members. I was just going over to their house to drop it off and this state trooper pulls me over. I asked him"what I did wrong officer". He said that my rear side windows are tinted. I told him that I thought I was allowed to have those tinted and he said its a new law and he has to write me a ticket. I said fine. He wanted my license and registration. I told him that I had a concealed pistol in the car and handed him my carrying permit. He asked me to hand over my gun. I said fine and gave him my gun. He said he is gonna run it to see if its mine and he will be right back. He came back 20min later and said everything checked out. He handed my gun back in pieces. He even took my spring out of my glock. I just looked at him since I didnt really want anytrouble. He said thats just in case I tried to shoot him when he turns around to go back to his car. Truthfully I can put back that gun and have a bullet in the chamber with my eyes closed before he makes it to his car with no problem but that was just weird that he did that. Then he asked me if there is anything else in the car that I am not suppose to have. I told him that I thought that I was allowed to have my gun according to the constitution. Then he refrased and asked me if I mind incase he wanted to look around. I thought that it meant just looking in my car, not a full blown search. So I said fine b/c I didnt want trouble. He opened my door for me and told me to go sit on the guard rail. He ripped apart everyting in the car(glove compartment, under mats, under seats,trying to shove his hands in the side consoles of my doors). In the trunk, he got to my gym bag and pulled out all my supplement bottles. He started asking me how I know that it is really glutamine in the bottle and also started sniffing the ripped fuel bottle. Also started asking me what I do for living and if I went to school for it etc. I dont understand. Fuck, what happened to my constitutional rights???????
I am just left speechless b/c all I wanted to do was cooperate with the police. And if you are wondering, yes I had to get my tint taken off the rear windows b/c he wrote me a ticket.
I am sorry for this long ass emial but I just had to vent.

It's really unfortunate that happened to you. It kinda sucks, because all a police officer needs to do in order to search your car like that is get your permission. If he asked you if he could look around, and you said yes... technically he can search your whole car... I don't know about opening your bags though... he'd need to have a warrant for that, unless you said he could look in it. Also, if he did find something in there, you could probably get it thrown out because (from what you said) it was your belief he just wanted to "look" around the car, not tear it all apart. The best thing to do if a cop asks you if he can "look around" your car, is just say no. If you think it will give more trouble, you can be specific and say "you can just look around, but I don't want you to tear everything up"...

That is how it is on paper, but in the real world it is a little different... it's a shame that police get on power trips like this.

With billions of emails and cell phone calls placed everyday, I highly doubt they have the time or resources available to bother with someone like you or me. I wouldn't sweat it.

I agree with LiftOrDie... I doubt they'll be searching our e-mails... there are MILLIONS of em out there. Also, under the new laws, they don't have the ability to search your e-mails... they need to be doing an investigation on terrorism... it doesn't leak over into importation of AS.

citrus are you a lawyer? i mean i think this whoel law is realy for drugs not teroaim i mean c'mon u dont think terosists watch the news? they change there way of comunication .

Have you looked at the new law? I am currently in my 3rd year of school and we have went over this new legislation in detail. THEY DO NOT NEED PROBABLE CAUSE to get these taps. The old laws on the books would allow them to get permission from a magistrate to search and seize anyone if probable cause was found. That was the problem. Now, in the face of the the current problems, they are merely stating that your 4th Am. rights are less important than national security.

IMPORTANT: Just because the legislature passes some new law DOESN'T make it Constitutional. I am quite sure that if and when an abuse of this new law is used to prosecute a "non-terrorist", there will be a judicial challenge. It may be protected under some sort of "plain view" analysis but that is unlikely.

I think we all should be safe but also more careful. Remember, you never know who you are talking to!


I have never done anything illegal and don't intend to. Just my 2 cents.

First, the new laws will have nothing to do with any of us unless we are suspected of being terrorists. And feds will have to prove that with some juicy evidence. It won't effect us at all.

Nothing happened to your rights, but YOU chose not to USE them!
If you want to excersize your rights, then KNOW what your rights are!

Not only do you have the right to refuse this search, but you can refuse it ANY TIME DURING the search. Yes, that's right, you can change your mind and he has to stop IMMEDIATELY.

Maybe you said something or gave him an impression to lead him to think that you might be hiding something, but never think that just because you say they can search your car that they are going to assume you are innocent because of it. If a cop asks you to search your car, 99 times out of 100 he is going to rip through your car if you give him permission, they aren't asking as a hypothetical. For now on JUST SAY NO to searches. ;)
