The Steroid Barrister

Most of you are familiar with the name Rick Collins in light of his interviews here at T-Mag. Rick is the attorney you call when you get busted for possession of anabolic steroids (see www.steroidlaw.com for more info.)

Rick has a new book coming out called Legal Muscle: Anabolics in America. I'd planned to interview Rick regarding this book when a more interesting topic of discussion came about. I'm sure you'll appreciate me discussing the topic of my conversation with Attorney Collins and I promise to review and discuss his book in the near future.

Here's something your readers may need to know about. As more and more people are being arrested for GHB-related substances pursuant to the DEA's "Operation Webslinger," here's a brand new decision by a federal judge in New York. I represent (name edited), and Judge Sweet's decision mirrors my extensive briefs on the issues. It's a rare event when a judge dismisses a federal criminal indictment, but it's even more unheard of when he does it by declaring a law unconstitutional. That's what he did.

Specifically, he held that the Analogue Statute to be unconstitutionally void for vagueness as applied to butanediol, both on grounds of notice and as to arbitrary enforcement. Needless to say, the ruling jeopardizes prior convictions and pending cases. It throws a monkey wrench into the DEA's recent sweep. Federal prosecutors are beside themselves, and will no doubt marshal all their might to gang up on me at the appellate level. I'll almost certainly be arguing this case before the Second Circuit Court of Appeals within a few months.

This is fantastic news, and not just for those who want to abuse butanediol. What it means is that the government is going to have to show a lot more evidence if it wants to nail someone on the "analog" law. This ruling could have profound implications for prohormones/pro-steroids (in a good way).

At the very least, this ruling will make if very difficult for the DEA/FDA to ban prohormones outright as "analogs of C-III anabolic steroids" and it will force them to go after each individual prohormone/pro-steroid one at a time if they want to try to ban them. It'll also force them to show a lot more evidence than they're probably used to gathering and presenting in these type of cases.

We all owe Rick Collins a huge debt of gratitude for taking and arguing this case. Thanks a million, Rick!
