Law experts...mail order question....

biogeared

New member
Here's a thought I posted on another thread, but I will ask the pros.

When ordering some gear, here is a hypothetical situation I have created:

Say your name is "Darren."

Have have the package sent to "Darrek". The postal people will still think its your package as it is only a slight spelling mistake. If you get busted, you can try and plead that it's not your package, the name isn't even yours.

Will changing a name like that lead to fraud charges?? Any idea if it would stand up in pleading that it wasn't your package??

Any thoughts on whether its a good or bad idea?

Thanks. :fro:

1) NEVER seen a mail fraud count based on a name error. After all, the SENDER could have simply made a mistake. Of course, someone silly enough to admit they INTENTIONALLY ORDERED it to a false name is practically asking to be charged.:saw:

2) ACCEPTING POSSESSION of the package is the problem, NOT the name on it. This is a fundamental concept that everyone should know who is interested in these hypotheticals. It's discussed AT LENGTH in the book. Respectfully, you should spend some time going over it.
